Tēma “Obligāta notariālā akta forma darījumiem ar nekustamajiem īpašumiem. Pozitīvie un negatīvie aspekti.”, tika izvēlēta, jo šobrīd tā ir aktuāla, pamatojoties uz to, ka atsevišķa sabiedrības daļa ir ierosinājusi veikt reformas nekustamā īpašuma darījumu jomā. Uz šī ierosinājuma pamata, šobrīd Latvijas Republikas Tieslietu ministrijā ir izveidota darba grupa “Priekšlikuma ieviest obligātu notariālā akta formu nekustamo īpašumu atsavināšanas darījumiem” izvērtēšanai. Darba mērķis ir noskaidrot vai ir nepieciešams ieviest obligātu notariālā akta formu darījumiem ar nekustamajiem īpašumiem. Darba rakstīšanas laikā tiek noskaidroti dažādu sabiedrības locekļu viedokļi (Zvērinātu advokātu, Latvijas Tirdzniecības un rūpniecības kameras, Finanšu ministrijas, Zvērinātu notāru) par reformas nepieciešamību un lietderīgumu, tiek analizēta juridiskā literatūra un citi informācijas avoti. Darbs sastāv no trīs nodaļām, kur pirmajai un otrajai darba nodaļai ir trīs apakšnodaļas, savukārt trešajai nodaļai ir divas apakšnodaļas. Darbam ir viens pielikums. Pirmajā darba nodaļā ir analizēti tiesiski darījumi, t.i. līguma jēdziens, līguma brīvības princips un līguma forma. Otrajā darba nodaļā ir analizēts notariāls akts un paraksta īstuma apliecinājums. Trešajā darba nodaļā ir analizēti pozitīvie un negatīvie aspekti obligātai notariālā akta formas ieviešanai darījumiem ar nekustamo īpašumu. Darba rezultātā darba autore ir noskaidrojusi vai obligāta notariālā akta forma ir jāievieš un vai tā ir jāpiemēro visiem subjektiem, nekustamā īpašuma darījumu slēgšanā, vai arī tikai konkrētam subjektu lokam (piemēram, fiziskām personām). Papildus tam, darba autore darba rezultātā secina, ka ir nepieciešamas izmaiņas likumos un vairākiem likumiem piedāvā jaunu likuma redakciju. Theme "Compulsory notarial form in transactions with real estate. Positive and negative aspects.", was chosen since currently it is topical, based on the fact that a separate public group has proposed to make reforms in the business aspect of real estate. On the basis of this proposal, currently, the Ministry of Justice of the Republic of Latvia has established a working group for evaluation of 'The proposal to introduce compulsory notarial acts in a form of real estate property disposition transactions''. The objective of the work is to find out whether it is necessary to introduce compulsory notarial acts in a form of transactions with real estate. In the works of this research, it has been found out that various members of the public opinions ( Attorney, Latvian Chamber of Commerce and industry, the Ministry of finance, sworn notaries ) on the necessity and usefulness of the reform are analysed in the legal literature and other information sources. The work consists of three chapters, where the first and second chapter has three subdivisions while the third chapter has two subdivisions. Work has one annex. In the first work section legal transactions, i.e. the contract term, the principle of freedom of contract and contract form have been analyzed.The second chapter contains the analysis of the work of the notarial deed and signed proof of claim. The third chapter contains analyses of positive and negative aspects in the form of notarial obligatory implementation of transactions with real estate. In the result of this work the author has learned if mandatory notarial act must be implemented and whether it should be applied to all entities, in the real estate transaction closing or only for a certain group of subjects (e.g. individuals). In addition, the author concludes that changes are needed in laws and offers a new wording of the laws current version.
