Zemesgrāmatā nostiprināmās tiesības

Abstract

Bakalaura darba tēma ir „Zemesgrāmatā nostiprināmās tiesības”. Darba mērķis ir noskaidrot to tiesību loku, kuras iespējams nostiprināt zemesgrāmatā, kā arī noskaidrot zemesgrāmatā ierakstāmos tiesību aprobežojumus un nodrošinājumus. Bakalaura darbs sastāv no trijām nodaļām, kurās aplūkotas zemesgrāmata nostiprināmās lietu tiesības, zemesgrāmatā nostiprināmās saistību tiesībās, ka arī zemesgrāmatā ierakstāmie tiesību aprobežojumi un nodrošinājumi. Bakalaura darba galvenie secinājumi: jauna tiesību institūta – apbūves tiesību regulējums ir pārlieku plašs, un to nepieciešams konkretizēt; zemesgrāmatā nostiprināmas ne tikai lietu tiesības, bet ar likumu noteiktas saistību tiesības; dzīvojamo telpu īres tiesībām ir prioritārs statuss pār īpašuma tiesībām.

The topic of Bachelor’s thesis is “Rights registered in the Land Register”. The goal of the Bachelor’s thesis is to distinguish the array of rights, which are possible to corroborate in the Land Register, also clarifying legal restrictions and provisioning registered in the Land Register. The Bachelor’s thesis is made up of three chapters in which the fallowing rights which are possible to corroborate in the Land Register are inspected: rights in rem, liability law and legal restrictions and provisioning. The primary conclusions of the Bachelor’s thesis are: the regulation of the new law institute the building rights is too broad and is in need to be concretized; not only rights in rem are corroborated in the Land Register, but also a particular set of liability rights that are identified by law; residential space rental rights are in a way prioritized over the ownership rights.
