Darba mērķis ir izpētīt, vai Latvijas normatīvajā regulējumā ir ievērota konsekvence attiecībā uz kritērijiem un atbrīvošanas kārtību valsts amatpersonu atcelšanai no amata. Tika secināts, ka Latvijas normatīvais regulējums ir nekonsekvents. Arī ārvalstīs nav vienota modeļa amatpersonu atbrīvošanai no amata. Tāpat tika secināts, ka tiesības pārliecināties par Saeimas pieņemtā lēmuma tiesiskumu personām ir tāpēc, ka tās pilda valsts dienestu Latvijas Republikas Satversmes 101. pantā izpratnē. Tā kā Saeimas lēmums par valsts amatpersonas atbrīvošanu no amata, šajā gadījumā ir administratīvais akts, tā pārsūdzēšana iespējama administratīvajā tiesā. Efektivitātes un lietderības apsvērumu dēļ būtu nosakāma lietas izskatīšana vienā instancē. The aim is to analyse whether the coherence in Latvian regulatory framework is observed regarding the criteria and the release procedure of certain state officials. It was concluded that Latvia’s regulations are inconsistent. Also abroad an unified pattern of the dismissal of state officials has not been observed. It was found that the right to ensure the validity of the ruling of Saeima is granted as it fulfils state service according to Article 101 of the Constitution of the Republic of Latvia. As Saeima’s ruling of the dismissal of state officials from office, if it is justified by legal criteria, is an administrative act, its appeal is achievable in the administrative court. Due to reasons of efficacy and performance, legal proceedings should be determined in single body.
