Partnerattiecību tiesiskie jautājumi un problēmas Latvijas republikā

Abstract

Maģistra darba uzdevums bija izpētīt nereģistrētā kopdzīvē dzīvojošu pāru savstarpējo attiecību tiesisko regulējumu. Ņemot vērā mūsdienu sabiedrībā aizvien augošajai tendencei pārim dzīvot vienkāršā kopdzīvē, turpat dalīt saimniecību ar otru pusi un audzināt bērnus. Darba autore uzskata, ka ir nepieciešams aplūkot tiesiskos mehānismus, ar kuru palīdzību pāris varētu savstarpējas attiecības sakārtot. Ģimenes jēdziena plašāka analīze darba ietvaros ļauj izprast ģimenes formas gan dažādās sabiedrībās, gan dažādos laikos. Aplūkojot ģimenes jēdzienu, ir iespējams konstatēt, ka ģimene savā saturā ir plašāka, nekā tas atsevišķos normatīvajos aktos tiek piedāvāts. Darba pirmajā nodaļā tiek aplūkots jautājums par ģimeni vēsturiskā aspektā, līdz pat mūsdienām. Atsevišķa uzmanība tiek pievērsta ģimenes jēdziena vēsturiskai attīstībai Latvijā. Nereģistrētā kopdzīvē dzīvojošiem pāriem tiek piedāvāti dažādi civiltiesiskie mehānismi savstarpējo attiecību sakārtošanai. Darba otrajā nodaļā tiek pievērsta uzmanība tieši šiem iespējamajiem veidiem, kā personas var sakārtot savstarpējas attiecības. Tāpat tiks apzinātas problēmas, ar kurām var saskarties tiesiskā regulējuma piemērošanā. Savukārt darba trešajā nodaļā, tiek plašāk aplūkoti piedāvājumi tiesiskā regulējuma grozījumiem, papildinājumiem. Master thesis main aim was to explore legal framework of relationships between two people who live in unregistered cohabitation. Regarding to the growing trend in modern society for couples living in simple cohabitation, furthermore split and share household and rise children together. Author of master thesis believes that it’s important to explore legal framework and possible mechanisms of this legal framework, with which couple could settle legal relationships between one and another. Exploring the concept of family as a legal term, in master thesis helps to understand more about families forms in different societies and times. Further exploring family as a legal term, it’s possible to find out that family definition has a bigger concept than it’s incorporate in legal framework, what can be found in legislature. In first chapter of master thesis author looks at family definition form historical side, till modern society. Separate attention is for history of family in Latvia. Couples living in unregistered cohabitation are offered various legal mechanisms that those couples can use for legal relationship definition. The second chapter focuses on precisely those possible ways for such people’s possibilities to arrange mutual relations. There will also be identified problems which may be faced by the application of the legal framework. On the other hand on third chapter of master thesis, it will focus mainly on possible legal options in future, how could be change legislation so that couples could gain more rights.
