Termiņu nodokļu tiesībās aktuālās problēmas

Abstract

Nodokļu jomā ir noteikti daudzi termiņi, tomēr ne vienmēr no likuma skaidri izriet to būtība, grozīšanas iespējamība un nokavējuma sekas. Tiesu praksē pastāv nevienprātība par dažādiem termiņiem, un šajā darbā autore sniedz savu viedokli un secinājumus par to, kāds būtu pareizākais risinājums dažādām problēmsituācijām. Autore norādījusi uz tiesu praksē izdarītajiem nepamatotajiem secinājumiem par termiņiem nodokļu tiesībās, kā arī piedāvājusi risinājumus, kā interpretēt un piemērot spēkā esošos normatīvos aktus.

Even though there are various deadlines set in the field of taxation, the law does not always provide a clear understanding of the esence of such deadlines, as well as the possibilities of modification thereof and the consequences of exceeding the deadline. The case law is not in consesnus regarding various deadlines and here author of this thesis provides an opinion and conclusions on what would be the best soution for different problematic cases. The author has indicated unjustified conclusions regarding deadlines in tax law, often seen in the case law, as well as offered solutions on the interpretation and application of the legislative enactments in effect.
