Konvencijas 5.pants paredz personas tiesības uz brīvību, vienlaikus norādot uz izņēmumiem, kuros personas brīvības atņemšana ir tiesiska. Darba mērķis ir konstatēt Konvencijas 5.panta apakšpunktu patieso tvērumu, kas tieši neizriet no Konvencijas teksta. Darba uzdevums ir analizēt Eiropas Cilvēktiesību tiesas praksi, izdarot secinājumus par kritērijiem, kas jākonstatē katrā konkrētā situācijā, lai atzītu, ka personas brīvības atņemšana bijusi tiesiska, kā arī definējot tos Konvencijas 5.panta jēdzienus, kuru saturs ir neviennozīmīgs. Darba rezultātā tiek sniegtas atziņas par tiem Konvencijas 5.panta elementiem, kuru satura definēšana Eiropas Cilvēktiesību tiesas praksē izrādījusies visstrīdīgākā. Article 5 of European Convention on Human Rights guarantees right to liberty and security while at the same time references to the exceptions when right to liberty can be restricted. Purpose for the work is to analyze subparagraphs of the Article 5 noting these provisions true scope which could be not seen from the text of the Convention. Work assignment is to analyze European Convention on Human Rights case law and make conclusions about criteria which should be complied with to accept that detention of a person have been lawful and define the terms which content is contrary. Work leads to interpretation recommendations about those elements of Article 5 that proved to be the most contentious in European Court of Human Rights in practice.
