Maģistra darba mērķis ir apzināt judikatūras maiņas metodoloģiju civillietās, kā arī konstatēt tās pieļaujamības kritērijus. Lai īstenotu darba mērķi, darba autore analizējusi un noteikusi judikatūras jēdzienu un tās maiņas pieļaujamības kritērijus. Darba ietvaros analizēti vairāk nekā piecdesmit Latvijas tiesu nolēmumi, tādējādi konstatējot judikatūras maiņas metodoloģijas neesamību un judikatūras maiņas ietekmi gan uz citiem tiesas nolēmumiem, gan likumdevēju. Darba autore izvirza kritērijus judikatūras maiņas pieļaujamībai, turklāt izvirzot tēzi, ka, mainot aktuālo judikatūru, tiesas pienākums ir to argumentēt, norādot arī iemeslus, kāpēc jaunā juridiskā atziņa ir nepieciešama. The main objective of this Master’s thesis is to comprehend the methodology of changed case law in civil cases as well as to define its admissibility criteria. In order to attain the objective of this work, the author analysed and defined the concept of the case law and its admissibility criteria for changing case law. More than fifty decisions made by the Courts of the Republic of Latvia were investigated for this work leading to conclusions that there is an absence of changed case law methodology furthermore other courts decisions and even legislator is influenced by changed case law. The author proposes criteria for the changed case law admissibility, in addition adding a thesis statement which – by changing the current case law, the court’s duty is to provide arguments for why the proposed changes are necessary.
