Tiesības dzīvot labvēlīgā vidē un to aizsardzība Satversmes tiesā

Abstract

Maģistra darba tēma - „Tiesības dzīvot labvēlīgā vidē un to aizsardzība Satversmes tiesā”. Vides tiesības ir mainīgas tiesības, kas attīstās kopsakarā ar citām interesēm - ekonomiskām, sociālām un kultūras. Darba temats ir aktuāls, jo arvien pieaug sabiedrības interese par darbībām, kas tiek veiktas tai apkārt – klimata pārmaiņas, piesārņojums u.c., tādējādi ietekmējot vidi un personu tiesības dzīvot labvēlīgā vidē. Darba mērķis ir izpētīt tiesību uz labvēlīgu vidi saturu un analizēt šo tiesību aizsardzības praksi Latvijā, izprast tiesību uz labvēlīgu vidi pieejamos aizsardzības mehānismus Latvijā, kā arī noskaidrot tiesību uz labvēlīgu vidi attīstību un uzskatus par tām kā cilvēka pamattiesībām. Maģistra darbā aplūkots pētāmā temata teorijas atspoguļojums un prakse. Izdarīti secinājumi par problēmjautājumiem un iespējamajiem risinājumiem. Pētījuma uzdevums ir izpētīt un izanalizēt tiesības dzīvot labvēlīgā vidē kā pamattiesības un kā tās aizsargāt Satversmes tiesā. Aplūkot nacionālo regulējumu un izpētīt Eiropas Cilvēktiesību tiesas praksi saistībā ar tiesībām uz labvēlīgu vidi. Cilvēka labklājība ir ciešā sasaistē ar labvēlīgu apkārtējo vidi. Lai veicinātu efektīvu tiesību aizsardzību, ir jāizvērtē problēmjautājumi, kas atspoguļojas praksē.

The title of the Master’s thesis is "The Right to Live in a Benevolent Environment and the Protection in the Constitutional Court." Environmental law is variable and it is developing in conjunction with other interests – economic, social and cultural. The subject of the Paper is topical as the public interest in ambient activities – climate change, pollution, etc. is growing that is affecting the environment and the rights of individuals to live in benevolent environment. The Paper aims to examine the contents of the right to live in a benevolent environment and analyses the law enforcement practice in Latvia. It is focused on understanding the available protection mechanisms for rights to benevolent environment as well as to clarify development of rights to benevolent environment and perceptions on them as fundamental human rights. Master thesis deals with the reflection of the study subject in theory and practice. Conclusions are drawn about problem issues and their possible solutions. The study aims to examine and analyse the rights to live in a benevolent environment as a fundamental right and the ways of its protection in the Constitutional Court. National legislation is reviewed and the practice of the European Court of Human Rights is examined. Human well-being is closely linked to a favourable environment. In order to facilitate an effective protection of the rights, it is necessary to examine the problem issues that are reflected in the practice.
