Maģistra darba nosaukums ir ”Brīdis, ar kuru Satversmes tiesā apstrīdētā norma (akts) zaudē savu spēku”. Mērķis ir pētīt un analizēt Latvijas konstitucionālajā tiesā par prettiesisku atzītu normu spēku laikā, bet uzdevumi: aplūkot tiesību normas un metodoloģiju, kas tiesai jāievēro šī jautājuma izlemšanā; konstatēt tiesiskā regulējuma (prakses) nepilnības un formulēt priekšlikumus to novēršanai. Pētījums sastāv no 5 nodaļām, un tajā galvenokārt analizēta līdzšinējā Satversmes tiesas prakse. Darbā izmantota analītiskā, deduktīvā, induktīvā un salīdzinošā pētniecības metode. Darbā tika secināts, ka: Satversmes tiesa praksē pārkāpusi nozīmīgus ierobežojumus, lemjot par brīdi, ar kuru antikonstitucionāla tiesību norma zaudē spēku; samērīguma principa ievērošanai tiesai būtu jāizmanto līdzsvarošanas metode; Satversmes tiesas likumā būtu izdarāmi grozījumi, tostarp, lai veicinātu lietas dalībnieku iesaisti pamatošanā. The title of Magister Thesis is ”Moment with which the norm (act) challenged in the Constitutional Court of Latvia ceases to be in force.” The aim is to study and analyze the legal effects in time for norms (acts) deemed unconstitutional by Constitutional Court of Latvia. To achieve the aim it is necessary to: explore legal framework and methodology that court must observe when deciding on the issue; establish imperfections in the legal framework and case law; produce proposals to overcome them. The study consists of 5 chapters, and it mainly analyzed the current practice of the Constitutional Court of Latvia. The author used analytical, deductive, inductive and comparative research methods. It was concluded that the Constitutional Court of Latvia had violated a few important limitations when deciding on the date when the unconstitutional provision shall cease to be in force. It was also deduced that: in order to fully respect the principle of proportionality, the Court should be using Law of Balancing; a few amendments are necessary in Constitutional Court Law to facilitate the parties' involvement in the justification and for other reasons.
