Pašvaldības saistošo noteikumu izdošanas un tiesiskuma kontroles problemātika

Abstract

Bakalaura darbā “Pašvaldību saistošo noteikumu izdošanas un tiesiskuma kontroles problemātika” tiek pētīta pašvaldībām piešķirtā tiesība izdot ārējos normatīvos aktus, pētīti un atklāti tie kritēriji, kurus pašvaldībām nepieciešams ievērot, izdodot saistošos noteikumus, kā arī atklāti būtiskākie pašvaldību veiktie pārkāpumi, neievērojot obligātos priekšnosacījumus saistošo noteikumu izdošanas pieļaujamībai. Darbā tiek pētītas vairāku pašvaldību saistošo noteikumu normas, kas nosaka administratīvo atbildību, tiek sniegti arī ierosinājumi kā uzlabot to izkārtojumu un uztveramību. Darba ietvaros pētīta tiesu prakse, pašvaldību ieradumi izdodot saistošos noteikumus, tajos ietverot administratīvo atbildību paredzošās normas, kā arī salīdzināts Latvijā pastāvošais tiesiskuma nodrošināšanas mehānisms ar ārvalstīs esošo. Tiek sniegti ierosinājumi kā uzlabot saistošo noteikumu, kuros paredzēta administratīvā atbildība, izdošanas tehniku, arī sniegts priekšlikums kā uzlabot tiesiskuma kontroli pār saistošo noteikumu izdošanu.

Bachelor theses titled "A critical review of the issues in the monitoring and control of regulations issued by local authorities in light of their compliance with main government laws" studies the topic of granting municipalities the right to pass external laws and regulations, as well as the criteria the municipalities need to follow while passing the byelaws and the most important violations when the mandatory minimum conditions were not met. In this work the regulations of byelaws of the several municipalities is studied, which defines administrative responsibility for byelaws violation. Recommendations are given on improving the enforceability and byelaws issuing. This work studies court practices, the practices of local municipalities byelaws passing, the administrative liability in the anticipated norms, as well as the comparison of Latvian mechanism for ensuring the rule of law is compared with the foreign one. The work provides suggestions of how to improve the byelaws in which the administrative responsibility is foreseen, how to improve the passing, as well as offers a proposal on how to improve the legality of passing bylaws.
