Darba mērķis ir aplūkot jautājumus, kas saistīti ar vainas formas noteikšanu noziedzīgos nodarījumos ar saliktu sastāvu, kad personas vainas forma pret izdarīto darbību (bezdarbību) ir nodoms, bet attiecībā uz kaitīgajām sekām tiek konstatēta neuzmanība. Šādi noziedzīgi nodarījumi Krimināllikumā ir diezgan daudz, un attiecībā uz lielāko daļu no tiem praksē ir nostiprinājies, ka tie ir jākvalificē kā izdarīti ar nodomu. Taču ir daži nodarījumi (piemēram, Krimināllikuma 138. pants, 260. pants), kuriem praksē ir problēmas noteikt kopējo vainas formu. To atzīst arī Iekšlietu ministrijas Informācijas centrs, kad tam tiek uzdots nosūtīt ziņojumu par kādas personas sodāmību. Krimināllikuma normas tieši neregulē šo problēmjautājumu, kā arī Latvijas tiesībzinātnieku viedoklis atšķiras. Darbā tiks apskatīti dažādi viedokļi šajā jautājumā un autors izteikts savas domas par šiem uzskatiem. Tāpat tiks piedāvāti konkrēti risinājumi šim problēmjautājumam. Lai to izdarītu, tiks apskatīts nodoma institūts, noziedzīga nodarījuma ar saliktu sastāvu jēdziens un jautājumi saistībā ar vainas formas noteikšanu noziedzīgos nodarījumos ar saliktu sastāvu. This article is devoted to the questions linked with determination of form of guilt in criminal offences with composite substance. Criminal offence with composite substance is when culprits attitude against activity is in form of intent, but attitude against result is detectable as negligence. There are many norms in Latvian Criminal Law with that kind of substance and most of them are qualified as done with intent. But there are few norms ( for example, Section 138., 260.) where Information centre of Ministry of the Interior recognizes problems in determination of form of guilt. Criminal Law does not directly says how to deal with this problem, and there are different opinions in between Latvian law scholars. The author will deal with several opinions and will recommend some solutions in this matter. In order to resolve these problems, the author will deal with institute of intent, conception of criminal offences with composite substance and questions linked with determinations of form of guilt in such offences.
