Ierobežojumi Eiropas Savienības pilsoņu tiesībām brīvi pārvietoties un uzturētied citā Eiropas Savienības dalībvalstī

Abstract

Pētījumā apskatīts vispārīgs personālais un materiālais tvērums tiesībām brīvi pārvietoties un uzturēties citā dalībvalstī, kā arī konkrētāk analizēti šo tiesību ierobežojumi sabiedriskās kārtības, valsts drošības, sabiedrības veselības apsvērumu dēļ, kā arī ierobežojums saistībā ar pārmērīgu slogu uzņēmējas dalībvalsts sociālās palīdzības sistēmai. Pētījuma galvenais mērķis ir noskaidrot, cik efektīvi ir šie ierobežojumi mūsdienu situācijā. Pētījuma uzdevums: analizēt attiecīgos tiesību aktus un judikatūru, izvērtējot būtiskos apstākļus, kas jāievēro, pieņemot lēmumu par izraidīšanu. Pētījumā ir secināts, ka ne vienmēr citas dalībvalsts pilsoņa izraidīšana pasargā uzņēmējas dalībvalsti, jo atsevišķos gadījumos Eiropas Savienības pilsoņi apdraud ne tikai konkrēto dalībvalsti, kurā tie uzturas, bet gan visu Eiropas Savienību un tās vērtības. Pētījums satur 45 lapaspuses.

This present research has inspected general personal and material scope of the rights of free movement and residence in another member state, as well as it analyzed restrictions on these rights based on considerations of public policy, public security, public health grounds and in a context of becoming a burden for the social services of the host Member State. The main aim of this research is to find out how effective are these restrictions at today`s situation. Tasks of the research are to analyze the appropriate laws and Court decisions, as well as to assess relevant circumstances, to which it needs to follow by accepting the decision about the expulsion. The research concludes that not always the expulsion of another Member State citizen protects the host Member State, specially, when at some situations citizens of the European Union endanger not only the specific Member State, where they reside, but the whole European Union and its values. The research contains 45 pages.
