Bakalaura darbs “Funkcionālā imunitāte par trešajā valstī veiktiem noziegumiem” sniedz ieskatu funkcionālās imunitātes būtībā, kā arī funkcionālās imunitātes piemērošanas subjektu noteikšanā un gadījumos, kad funkcionālā imunitāte kolidē ar citām starptautisko tiesību normām. Darba mērķis ir noskaidrot funkcionālās imunitātes (ratione materiae) tvērumu, personu un darbību loku, uz ko funkcionālā imunitāte ir attiecināma, kā arī izņēmumus no funkcionālās imunitātes piemērošanas. Darba gaitā tiek akcentēti tādi pastāvoši problēm jautājumi, kas izriet no ārvalstu tiesu jurisdikcijas, kā neskaidrība par personu loku, uz ko var attiecināt funkcionālo imunitāti, darbības, kas uzskatāmas par oficiālām, kā arī izņēmuma gadījumi, kad funkcionālo imunitāti saskaņā ar starptautiskajām tiesībām nav iespējams piemērot. Pētījuma rezultātā tiek konstatēti kritēriji, lai noteiktu gan personu, gan darbību loku, uz kurām var attiecināt funkcionālo imunitāti, kā arī gadījumi, kad funkcionālo imunitāti nevar piemērot un to pamatojums. Aizstāvēšanai izvirzīto tēžu skaitā autore iekļauj izvirzītos kritērijus un pamatojumu, kādi un kāpēc var būt izņēmumi no funkcionālās imunitātes. Bachelor’s Thesis “Functional immunity for crimes committed in third State” provides an insight of essence of functonal immunity as well as issues related to functional immunity of State officials like determining the subject and acts covered by functional immunity as well as issues arising from functional immunity’s colision with other norms of international law. The aim of this research is to determine the scope of functional immunity, which persons can enjoy functional immunity and for what acts, also exceptions from application of functional immunity. Therefore the main issues author has determined are the criteria in context of application functional immunity and also main exceptions, when according to international law functional immunity cannot be applied. As a result of this research author analyzed criteria, providing a test which needs to be followed in order to determine possibility of application of functional immunity. As final thesis of this research author provides aforementioned criteria and certain reasonable exceptions from functional immunity.
