Abstract

Bakalaura darba mērķis ir izpētīt hipotekārā kreditora nodrošinājuma un aizsardzības aspektus, gadījumos, ja ieķīlāto īpašumu atsavina sabiedrības vajadzībām nepieciešamā nekustamā īpašuma atsavināšanas likumā noteiktajā kārtībā. Darba pirmajā daļā autore pēta Latvijas tiesisko regulējumu attiecībā uz lēmuma pieņemšanu par īpašuma atsavināšanu sabiedrības vajadzībām un atbalsta grozījumu nepieciešamību. Darba otrajā daļā tiek analizēta hipotekārā kreditora interešu aizsardzība un izteikta kritika. Trešajā nodaļā izpēta spēkā esošo regulējumu par taisnīgas atlīdzības noteikšanu, izmaksas un sadales kārtību un to ietekmi uz hipotekāro kreditoru un sniegti priekšlikumi. Darba apjoms ir 43 lapaspuses. Izmantotās literatūras avotu saraksts satur 42 avotus.

The aim of the bachelor thesis is to explore the mortgage creditor's security and defence aspects of the cases where the mortgaged property is expropriated for the needs of the state or the public as provided by the law. In the first chapter of the paper the author explores the legal framework for the decision on the expropriation of property for public purposes in Latvia and the need to support the amendment. In the second chapter the author studies mortgage creditor's interest protection and expresses criticism. The third chapter explores the existing framework for the determination of fair compensation, and disbursement arrangements and their impact on the mortgage creditor and makes proposals. The total volume of the paper is 43 pages. Bibliography sources list contains 46 sources.
