Eiropas Ekonomikas zonas līguma virsmērķis ir homogēna normu piemērošana visā Eiropas Ekonomikas zonā, tādējādi stiprinot ekonomiskās un tirdzniecības attiecības starp valstīm. Eiropas Savienībā šo vienveidību nodrošina Eiropas Savienības Tiesa, tomēr ņemot vērā, ka vairums EEZ līguma normu ir ES normu reprodukcija, un EST savā atzinumā 1/91 ir norādījusi, ka pastāv fundamentālas atšķirības starp Savienības tiesību sistēmu un EEZ, ir svarīgi saprast, kā ES normas darbojas EEZ EBTA valstīs, un kādas ir atšķirības no ES, kas arī ir šī darba mērķis. Lai atbildētu uz šiem jautājumiem, darbā uzsvars tiks likts uz EEZ normu galvenā piemērotāja – EBTA Tiesas – atziņām, un salīdzinātas ar EST judikatūrā izteiktajām, lai saprastu ciktāl darbojas homogenitāte normu interpretācijā. Tāpat tiks apskatītas praksē izveidojušās neformālās metodes homogenitātes principa ievērošanā, visbeidzot īsi pieskaroties EST attieksmei pret EBTA Tiesas spriedumiem. The main objective of the EEA Agreement is to create a homogenous interpretation of relevant provisions throughout all of European Economic Area, with a view to strengthen economic and trade relations between the contracting parties. Within the EU, uniform interpretation of Union law is achieved through the Court of Justice of the European Union, however in its’ Opinion 1/91 it stated that there are fundamental differences between the objectives of the Union and the EEA. Given the fact that the majority of EEA law is a reproduction of EU legislation, questions of how EU law works in non-EU EEA states and the permitted divergences arises. The aim of this research is to answer those questions. In order to address those issues, an emphasis will be on the findings of the EFTA Court, which will further be compared with those of the CJEU, to see how far the homogeneity objective applies. This analysis will also turn its’ attention to informal ways of ensuring homogeneity throughout the EEA, and CJEU’s readiness to accept the jurisprudence of the EFTA Court in view of the aforementioned objective.
