Bakalaura darba tēma ir “Ierobežojuma nēsāt seju aizsedzošu apģērbu tiesiskais regulējums”. Šāds regulējums var aizskart personas tiesības uz reliģiskās pārliecības brīvību, jo galvassegu valkāšana ir viens no reliģiskās pārliecības izpausmes veidiem, īpaši islāma ticīgām sievietēm. Tā kā ierobežojums var tikt noteikts arī Latvijas normatīvajos aktos, ir nepieciešams izvērtēt tā ieviešanas nepieciešamību. Darba mērķis ir analizēt iespējamos iemeslus ierobežojuma nepieciešamībai. Darbā autore aplūko reliģijas brīvības principu, kā arī sniedz nelielu ieskatu musulmaņu galvassegu veidos. Īpaša uzmanība tiek pievērsta iespējamo ierobežojuma ieviešanas pamatu analīzei, kā arī tiek aplūkoti atsevišķu valstu tiesiskie regulējumi (tai skaitā Latvijas Republikas izstrādātais likumprojekts), un Eiropas Cilvēktiesības tiesas spriedumi temata kontekstā. Darba rezultātā autore secina, ka ir vairāki iespējamie pamati ierobežojuma nēsāt seju aizsedzoša apģērba noteikšanai, tomēr ne visi var tikt atzīti par pamatotiem. Līdz ar to, vēloties ieviest šādu regulējumu arī Latvijā, likumdevējam ir nepieciešams ļoti rūpīgi izvērtēt aizlieguma nepieciešamību demokrātiskā sabiedrībā. The theme of the bachelor’s paper is “Legislation for restriction to wear face covering clothes”. This regulation can insult person’s rights on freedom of religion because wearing of headscarf is one of the ways to express religious belief, particularly for women who belong to Islam. Since the restriction may be intended for the laws and regulations in Latvia, it is necessary to evaluate the necessity of its implementation. The goal of the research is to analyze the possible reasons for necessity of restriction. The author of the research deals with the principle of freedom of religion and gives a short introduction in types of Muslim headscarf as well. Particular attention is paid for the analysis of reasons for the possible implementation. In addition, national legal frameworks (including the draft law of the Republic of Latvia) and the European Court of Human Rights convictions are investigated. As a result of the research, the author makes a conclusion that there are several possible reasons for making restriction to wear face covering clothes, though not all of them may be recognized as legitimate. Thereby, in order to implement such regulation in Latvia, the legislator needs to estimate the necessity of restriction in democratic society very accurately.
