Kiberkara regulējums starptautiskajās publiskajās tiesībās

Abstract

Kopš datortehnoloģiju pieaugošās lomas mūsdienu sabiedrībā, kiberuzbrukumi kļūst arvien izplatītāki starpvalstu mērķu sasniegšanā. Kiberuzbrukumiem ir potenciāls radīt lielus postījumus, kas var eskalēties kiberkarā. Darba mērķis ir pētīt vai un kādā mērā uz kiberkaru ir attiecināmas šobrīd spēkā esošās starptautiskās tiesības, kas regulē bruņota spēka pielietošanu un bruņotu konfliktu. Lai sasniegtu darba mērķi, tiks pētīts vai kiberkarš un kiberuzbrukumi ietilpst spēka pielietošanas, bruņota uzbrukuma un bruņota konflikta definīcijā. Tiks pētītas atšķirības un kopīgās iezīmes kiberuzbrukumiem un konvencionālajiem uzbrukumiem, kā arī šo atšķirību un kopīgo iezīmju ietekme uz starptautisko tiesību regulējumu. Darba noslēgumā tiks izceltas būtiskākās nepilnības kiberkara regulējumā, kā arī iespējamie nepilnību risinājumi un ieteikumi.

Since the increasing role of computer technology in modern society, cyberattacks have become more frequent in interstate relations. Cyberattacks have the potential to cause grave damage that could escalate in to a cyberwar. The purpose of the research is to analyze if and to what extent does international law regulate cyberwar in the context of the use of armed force and armed conflict. In order to achieve the goals set for the research, author will analyze if cyberwar and cyberattacks can constitute the use of force, armed attack and armed conflict. Author will analyze the differences and similarities between cyberattacks and conventional attacks and the effect on international law of these differences and similarities. In the conclusion the author will highlight the biggest obstacles in the international regulation of cyberwar and also provide the possible solutions and recommendations.
