Darba devēja uzteikums, kas saistīts ar darbinieka uzvedību.

Abstract

Bakalaura darba tēma ir: “Darba devēja uzteikums, kas saistīts ar darbinieka uzvedību”. Lai gan Darba likumā un citās tiesību normās ir stingri noteiktas darba devēja tiesības un pienākumi, uzsakot darba attiecības, tomēr tiesu praksē vēl joprojām ir gadījumi, kad darba devējs pārkāpj Darba likuma noteiktās robežas vai neievēro tās vispār. Bakalaura darba mērķis ir apskatīt darba devēja uzteikumu saistītu ar darbinieka uzvedību jēdzienu, kārtību un Darba likumā noteikto uzteikuma pamatojumu, lai varētu izprast, kādās situācijās darba devējs ir tiesīgs uzteikt darba attiecības, lai pēc tam varētu izanalizēt pastāvošās problēmas. Kā arī tika, apskatīta Latvijas tiesu prakse darba strīdos, lai izpētītu pašreizējo situāciju un pārkāpumus darba attiecībās. Bakalaura darba uzdevums ir: 1. Izpētīt Darba likumā regulēto uzteikuma jēdzienu, būtību un kārtību; 2. Aplūkot darba devēja tiesības un pienākumus, uzsakot darba attiecības ar darbinieku; 3. Analizēt Latvijas tiesu praksi darba strīdos par darba devēja uzteikumu, darbinieka uzvedības dēļ.

Bachelor's thesis: "The employer's notice of termination related to the conduct of the employee." Although the Labour Law and other legal norms are strictly defined in the employer's rights and obligations when starting a working relationship, but in practice very often it is far away from legal requirements as there are cases when the employer violates the limits imposed by the Labour Law or fails to comply with them at all. Topic of bachelor thesis and aim is to examine the employer's notice related to employee behavior concepts, procedures and the Labour Law of notice basis to be able to understand the situations in which the employer is entitled to terminate the employment relationship in order to then be able to analyze the existing problems regarding it. It was also reviewed Latvian court practice in labor disputes, to investigate the current situation and violations of labor relations. Bachelor's terms of reference are following: 1. Investigate and review Labour Law regulated cooling-off concept, substance and procedures. 2. Review the employer's rights and obligations when ending a working relationship with the employees; 3. Analyze Latvian court practice in labor disputes between the employer's notice of termination, the employee's behavior.
