Abstract

Maksātnespējas procesa efektivitātes problēmas un maksātnespējas procesa dalībnieku vilšanās procesā. Sabiedrība pēdējā laikā tiek informēta par šādu un līdzīgu problēmu esamību. Ņemot vērā pašreizējo sabiedrības ekonomisko saistību un finansiālo pienākumu nastu, kura jānes katram iedzīvotājam, neviens nav pasargāts no tādu procesu sakritības, kura noved pie maksātnespējas. Tādēļ, lai nepieļautu turpmāku maksātnespējas procesa efektivitātes principa pārkāpšanu, kas kavētu procesa gaitu un kaitētu tā rezultātam, ir ļoti svarīgi noteikt pašreizējo maksātnespējas procesa efektivitātes problēmjautājumus un rast uz tiem atbildes. Šajā pētījumā analizējot maksātnespējas likumu, judikatūru un citu valstu pieredzi, autors ir nonācis pie secinājumiem, kas, iespējams, būs noderīgi maksātnespējas procesa efektivitātes problēmu apzināšanai un to iespējamai prevencijai.

Insolvency process efficiency problems and disappointment of those who are involved in insolvency proceedings. Society has recently been informed of the existence of problems such as these as well as similar ones. Given the current economic commitments of society and financial burden that have to be carried by every citizen, no one is safe from a combination of circumstances that lead to insolvency. Therefore, in order to prevent further breaches of insolvency proceedings efficiency principle, which would delay the curse of the procedure and would be detrimental to the result, it’s very important to determine current insolvency process efficiency problems and to find solutions to these problems. In this study analyzing insolvency law, legal literature and experience of other countries, the author has come to conclusions, which will probably be useful to identify problems of efficiency of insolvency proceedings and their possible prevention.
