Jaunatklāti apstākļi administratīvajā procesā

Abstract

Bakalaura darbā „Jaunatklāti apstākļi administratīvajā procesā” pētīts procesa uzsākšanas no jauna sakarā ar jaunatklātiem apstākļiem tiesā institūts, kas tiesību zinātnē ir maz pētīts. Darbā ir analizēti likumā noteiktie kritēriji, lai procesu varētu uzsākt no jauna, pamatojoties uz jaunatklātiem apstākļiem, sniegts to juridiskais raksturojums, pētīta tiesu prakse attiecīgajos jautājumos un vērtēta normatīvā regulējuma efektivitāte. Bakalaura darba mērķis ir noskaidrot, kādi apstākļi administratīvajā procesā tiesā būtu vērtējami kā jaunatklāti, vienlaikus noskaidrot, kā notiek šī institūta piemērošana tiesu praksē un cik efektīvs ir šobrīd spēkā esošais regulējums. Darbā iegūtie rezultāti: autore piedāvā priekšlikumus uzlabojumiem gan tiesiskajā regulējumā, gan institūta definīcijā, kā arī sniedz viedokli par atsevišķiem problēmjautājumiem. The research in the bachelor paper “Newly-Discovered Facts in Administrative Procedure” has been done on the subject of Adjudication of Matters de novo in Connection with Newly-Discovered Facts, which hasn’t been deeply analyzed before. The scope of the research is related to law defined criteria of Adjudication of Matters de novo in Connection with Newly-Discovered Facts, studied legal analysis and related legal practice as well as effectiveness of existing regulations. The aim of the research is to find out which facts can be declared as Newly-Discovered Facts in parallel with its appliance and usage in everyday legal practice and how effective is existing regulation and legal frame. The results of the research: the author comes up with suggestions of changes both in legal regulation and change of the definition of the institute as well as gives an opinion regarding the problematic topics.
