Apbūves tiesība.

Abstract

Latvijas Civillikums nosaka zemes un ēkas vienotības principu. Tomēr dažādu faktoru ietekmē likumdevējs Latvijā ir pieļāvis dalīto īpašums, ko šobrīd likumdevējs mēģija izskaust, veicot grozījumus likumos un normatīvajos aktos. Latvijā ar 2017.gada 1.janvāri tiek nodibināts jauns tiesību institūts- apbūves tiesība. Tiesība ir kā alternatīva līdzšenējamam regulējumam būvēt uz svešas zemes, neradot dalīto īpašumu. Apbūves tiesība ir tiesība ir ar līgumu piešķirta mantojama un atsavināma lietu tiesība celt un lietot uz sveša zemes gabala nedzīvojamu ēku vai inženierbūvi kā patstāvīgu īpašuma objektu. Darba uzdevums ir izvērtēt apbūves tiesības institūtu kopsakarā ar Vāciju, Šveici un Igauniju apbūves tiesības normām, kā arī vēsturiski ar Romiešu tiesībās aprakstīto apbūves tiesību. Bakalaura darba aizstāvēšanai autors izvirza 4 tēzes un 1 priekšlikumus. Bakalaura darbā ir izmantoti 49 avoti.

Civil Law of Latvia recognizes principle of solo credit, whatever is affixed to the land belongs to the land. As result of different challenges in Latvia exists divided property, legislation now tries to limit divided property by changing laws and acts. From 1th January of 2017 in Republic of Latvia will be forced in law new institute of real property law- right of superficies (building right). The right is alternative to current framework to build on a foreign land, without making separate owner right of building. Superficies is a right established by a contract or heritage to build on someone else's land or use a building as an independent object of property. These kinds of buildings are engineering structures and not useable for living. Goals of Bachelor is to find out nature and scope of building right comparing it to German, Switzerland and Estonia legal framework of superficies . And as far it is possible find out similarities to right of superficies in Roman law. Author puts forward 4 theses and 1 suggestion. 49 units of sources were used in Bachelor.
