Elektroniskie pierādījumi ir salīdzinoši jauns pierādījuma veids, un to izmantošanu civilprocesā nosaka tiesa likuma noteiktajā kārtībā. 21. gadsimts ir tehnoloģiju laikmets, līdz ar tehnoloģiju attīstīšanos būtiski mainās arī elektronisko pierādījumu nozīme tiesu procesos. Pierādījumu avoti mainās un attīstās ik dienu. Elektroniskos pierādījumus civilprocess pieskaita pie rakstveida pierādīšana līdzekļiem, kuri ir vieni no svarīgākajiem pierādīšanas līdzekļu veidiem civilprocesā. Rakstveida pierādījumi ikdienā tiek pielietoti dažādās dzīves jomās t.sk. gan privātajā sfēra, gan biznesa sfērā. 21.gs. ietvaros rakstiskie dokumenti tiek nomainīti uz elektroniskajiem dokumentiem, kas dod iespēju ietaupīt materiālos līdzekļus un laiku. Līdz ar elektronisko dokumentu ieviešanu, mainās arī parakstīšanās - ar roku rakstīto parakstu nomaina elektroniskais paraksts. Līdz ar to Latvijas Civilprocesa likuma 110. pants, kas dod rakstveida pierādījumu jēdzienu, kas satur arī elektroniskos pierādījumus, neatbilst mūsdienu tehnoloģiju izmantošanas iespējām, sakarā ar šo pierādījumu formas plašo loku pieaugumu ir grūtības izmantot un iesniegt elektroniskos pierādījumus civilprocesā. Electronical evidence is a new type of evidence and its usage is defined in Civil Procedure law. The 21st century is the century of technology, therefore with the development of technology the importance of electronical evidence in court proceeding is changing with it. Sources of evidence are developing every day. Electronical evidence is considered as written means of evidence, which is most important evidence type in civil process. Written means of evidence are being used in different areas of life, including private sector as well as the business sector. In 21st century, most written documents are being electronized to save time, energy and many other sources like paper. With electronical documents coming in everyday life, many processes are changing like the way to sign a document, to make a deal etc. A person’s signature is changed to electronical signature. Article 110 of Latvian Civil Procedure law, which is giving the definition of written means of evidence, is not meeting the needs in the process of law. Nowadays technologies are being underrated because of incompetence of law and it is hard to use and submit electronical evidence in courts of civil procedure.
