Veselības aprūpes konstitucionālie pamati

Abstract

Maģistra darbā ir apskatīta pacienta-ārsta-valsts attiecību mijiedarbība veselības aprūpes nodrošināšanā. Darba apjoms ir 72 lappuses, darbs sastāv no ievada, piecām nodaļām un kopsavilkuma. Pirmajā nodaļā ir apskatīti starptautiskajos tiesību avotos atrodamie pacientu tiesību principi. Otrajā nodaļā ir aplūkoti informētās piekrišanas doktrīnas pirmsākumi ASV. Trešā nodaļa ir veltīta pacientu tiesībām Latvijas tiesību aktos. Ceturtajā nodaļā ir analizēti valsts pienākumi veselības aprūpes nodrošināšanā. Piektajā nodaļā ir aplūkota atbildība par tiesību pārkāpumiem. Kopsavilkumā ir norādīti nepieciešamie uzlabojumi veselības aprūpes tiesiskajā regulējumā. Dotas atsauces uz 143 literatūras avotiem.

The Master's thesis deals with the interaction of the patient-doctor-state relations in the provision of healthcare. The thesis is written on 73 pages and comprises an introduction, five chapters, and a summary. In the first chapter the principles of patient rights in international practice are surveyed and analysed. The origins of the doctrine of informed consent in the United States are described in the second chapter. The third chapter is dedicated to the patients rights that can be found in Latvian jurisprudence. In the fourth chapter the state's duties regarding the provision of healthcare are analysed. In the fifth chapter the responsibility for violations of rights are described. In the summary, needed reforms in the legal regulation of healthcare are indicated. The bibliography contains 143 references to the literature.
