Datu subjekta tiesību īstenošanas problēmas, piemērojot Vispārējo datu aizsardzības regulu

Abstract

Maģistra darbs apskata pašreiz ļoti aktuālu tēmu par nesen pieņemtās Eiropas Savienības Vispārīgās datu aizsardzības regulas piemērošanas jautājumiem. Neskatoties uz to, ka regula vēl nav piemērojama, un nav zināms, kā regulas normas tiks iedzīvinātas praksē, ir nepieciešams sākt diskusiju par tām tiesību normām, kuru piemērošana var radīt grūtības vai arī neskaidrības nākotnē. Autors maģistra darbā īpaši pievēršas datu subjektu tiesību problemātiskajiem aspektiem, vērtējot tos no datu subjekta tiesību īstenošanas skatupunkta. Tāpat autors apskata problemātiku, kas ir saistīta ar regulas teritoriālās darbības jomu. Izvirzītajiem problemātiskajiem aspektiem autors sniedz savu vērtējumu un priekšlikumus to novēršanai.

Master thesis examines currently very actual topic – about application issues of the recently adopted EU General Data Protection Regulation. Despite the fact that the regulation has not been applied yet, and it is not known, how provisions of the regulation will work in reality, it needs to start discussion about provisions of new regulation, which can cause potential difficulties in the future. In master thesis author is more focusing on problematic aspects of data subject’s rights, assessing them from the perspective of law enforcement. Author also examines possible difficulties associated with the territorial scope of the regulation. For every potential issue author gives his assessment and proposals as a solution for the situation.
