Patvēruma meklētāju izraidīšana no valsts kā ECK 3. panta pārkāpums

Abstract

Maģistra darba izvirzītais mērķis ir konstatēt, vai, un pie kādiem apstākļiem ar patvērumu meklētāja izraidīšanu no valsts var tikt pārkāpts ECK 3.panta aizliegums, un, kādus apstākļus vērtē Eiropas Cilvēktiesību tiesa šajā jautājumā. Attiecībā uz šo izvirzīto mērķi, tiks sniegts ieskats bēgļu neizraidīšanas principa saturā, analizējot šī principa tvērumu, kā piemēram, vai šis princips sevī ietver arī patvēruma meklētājus, atteikumu pie valsts robežas, kā arī tiks analizēta vajāšanas jēdziena izpratne. Skatot ECK 3.pantu, tiks piepildīti ar saturu tādi jēdzieni kā ,,spīdzināšana”, ,,cietsirdīga vai pazemojoša apiešanās vai sods”, kā arī skatīta patvēruma meklētāju izraidīšanas no valsts ECK 3.panta kontekstā, pievēršoties galvenokārt Eiropas Cilvēktiesību tiesas praksei attiecīgajā jautājumā. Master’s thesis objective is to establish whether and to what circumstances the expulsion of asylum seekers from the State might infringe the prohibition of Article 3 of the ECHR, and the circumstances assessed by the European Court of human rights in this regard. With regard to this objective, a view will be given to the content of the refugees principle of non-refoulement, analysing the scope of this principle, such as whether the principle includes, inter alia, asylum seekers, the refusal to the State border, and the understanding of the concept of persecution will be analysed. Viewing Article 3 of the ECHR, concepts, such as ,,torture” ,,cruel or degrading treatment or punishment” will be filled with content, as well as will be viewed expulsion of asylum seekers from the State in the context of Article 3 of the ECHR, focusing mainly on the case-law of the European Court of human rights on the subject.
