Bāriņtiesu institūts Latvijā: tiesiskais regulējums un realitāte

Ģimenes institūta analizēšana no privātā un publiskā aspekta ir aktuāla, jo ģimenes institūta neaizskaramības robežas, valsts iejaukšanās apjoma robežas un iejaukšanās pamatotība nav nepārprotami noteikta. Pētījumā iejaukšanās nepieciešamība ģimenes tiesiskajās attiecībās tiek vērtēta no bērnu tiesību un tiesisko interešu aizsardzības viedokļa, to vērtējot no ģimenes tiesību uz privātautonomiju aspekta. Pētījumā tiek analizēta bāriņtiesu loma bērnu tiesību nodrošināšanā un iejaukšanās robežas ģimenes privātautonomijā, un ar šiem jautājumiem saistītā problemātika. Bāriņtiesas institūta analizēšana ir aktuāla, jo, vērtējot bāriņtiesu darbību, rodas šaubas par bāriņtiesu amatpersonu un darbinieku kompetenci, bāriņtiesas institūta funkcionētspēju un nepieciešamību. Bieži tiek apšaubīts, ka bāriņtiesu amatpersonām un darbiniekiem ir izpratne par bērnu vislabāko interešu aizsardzības panākšanu. Apstāklis, ka bāriņtiesu amatpersonām un darbiniekiem, lai stātos darbā, nav obligāta prasība pēc juridiskās izglītības, sabiedrībā rada neuzticību bāriņtiesu institūtam, ko pastiprina nekvalitatīvi argumentētie lēmumi un atzinumi. Šie problēmjautājumi rada tiesu neuzticību bāriņtiesām, kā rezultātā bāriņtiesas zaudē savu efektivitāti un nepieciešamību. Pētījumā tiek secināts, ka, lai nodrošinātu bāriņtiesu pienācīgu funkcionēšanu, ir jāmaina normatīvo aktu bāze, reorganizējot bāriņtiesas institūtu. Tādējādi, lai nodrošinātu bāriņtiesu profesionālu funkcionēšanu, pētījuma autore izvirza priekšlikumu, ka visas sociālā rakstura, izmeklēšanas, pierādījumu vākšanas, lēmumu izpildīšanas funkcijas būtu jānodod pašvaldību sociālajiem dienestiem. It is timely to analyze the institute of family from private and public aspect of a concern because its limit of inviolability, extent of state interference and validity of interference are not distinctly defined. The necessity to interfere in legal relationships of family in the research is assessed from the rights and legal interests of a child, assessing it from the aspect of family right to private autonomy. The research analyzes the role of Orphan’s court in ensuring children’s rights and limits of interference in private autonomy of family and the related problems. The analysis of Orphan’s court is timely because during assessment of actions of Orphan’s courts occurs uncertainty about the competence of Orphan’s court officials and employees, the institute of Orphan’s court ability to function and necessity to exist. It is often questioned whether the officials and employees of an Orphan’s courts have understanding about ways how to achieve child’s best interests. The fact that there is no requirement for degree in law of an Orphan’s court official or employee as well as decisions and opinions of poor quality in society creates distrust in the institute of Orphan’s court. In eyes of courts these issues of concern creates the distrust in Orphan’s courts and Orphan’s courts are losing efficiency and necessity. The study concludes that to ensure the proper functioning of Orphan’s courts it is necessary to change its legislative framework and it is necessary to reorganize Orphan’s courts. To provide the professional functioning of Orphan’s courts, author proposes, that it is necessary to transfer all Orphan’s courts activities of social nature, functions of investigation, collection of evidence and execution of decisions to municipal social services.
