Sagatavošanas materiālu Latvijas nozīme likumdevēja gribas noskaidrošanā

Abstract

Darbā tiek pētīta sagatavošanas materiālu izmantošana likumdevēja gribas noskaidrošanā. Zinātniskā pētījuma mērķis ir izpētīt sagatavošanas materiālu lietošanu dažādās tiesību nozarēs, un izstrādāt sagatavošanas materiālu klasifikāciju, un izmantošanas metodoloģiju. Pētījuma sākumā autors analizē sagatavošanas materiālu jēdziena izcelsmi. Nākamās pētījuma daļas veltītas sagatavošanas materiālu izmantošanas izpētei starptautisko publisko tiesību un Eiropas savienības tiesību nozarēs. Darbā otrajā daļā tiek izpētīta sagatavošanas materiālu vieta tiesību avotu sistēma, un izmantošana Latvijas tiesu praksē. Pētījuma nobeigumā autors aplūko sagatavošanas materiālu savstarpējo iedalījumu, un attiecīgi arī to hierarhiju.

This research focuses on the preparatory work as source for ascertaining the original intention of the legislature. The scientific objective of the study is to investigate the preparatory work in various fields of law and development of the classification and methodology of the preparatory work. At the beginning the author analyzes the origins of the concept of the preparatory work. Further part of the research is devoted to analysis of the methodology and judicial practice of the preparatory work in public international law and European Union law. The second half of the paper the author studies position of the preparatory work in the sources of law system. In the final stage of this paper the author deals with the classification and the hierarchy of the preparatory work.
