Maģistra darba tēma ir ‘’Nepilngadīgo kriminālatbildības aspekti Latvijas un ārvalstu krimināllikumā’’. Darba mērķis ir analizēt nepilngadīgo kriminālatbildības regulējumu Latvijā un citās valstīs. Darbā tika izpētīti dažādu autoru zinātniskie viedokļi, kā arī dažādu valstu tiesību akti, kas regulē nepilngadīgo kriminālatbildības jautājumus, īpašu uzmanību veltot kriminālatbildības minimālajam vecumam. Tāpat tiek apskatīti jautājumi, kas saistās ar kriminālatbildības minimālā vecuma vēsturisko attīstību. Nosakot nepilngadīgo kriminālatbildības vecumu likumdevējs ir ņēmis vērā starptautisko dokumentu prasības. Atsevišķā nodaļā un apakšnodaļās ir apskatīti sodu veidi nepilngadīgajiem un to piemērošanas īpatnības Latvijā, kā arī tiek apskatīta šī institūta vēsturiskā attīstība, nonākot pie secinājuma, ka Latvijas Krimināllikumā nepieciešams veikt grozījumus, lai samazinātu minimālo brīvības atņemšanas termiņu. Tiek aplūkoti jautājumi, kas saistīti ar probācijas uzraudzību, sākot ar šīs institūcijas izveidi, tā vēsturisko attīstību un šā brīža regulējumu. Kā arī darbā tiek izskatīts jautājums par nepilngadīgo nosacītas notiesāšanas noteikumu piemērošanu nepilngadīgajiem, nonākot pie secinājuma, ka piemērojot nosacīto notiesāšanu ar probācijas dienesta palīdzību, izejot nepilngadīgajiem dažādās programmas sociālās korekcijas iestādēs, iespējams samazināt noziedzīgu nodarījumu recidīvu. Atsevišķa nodaļa ir veltīta audzinoša rakstura piespiedu līdzekļu piemērošanai, tā vēsturiskā attīstība Latvijā, kā arī praktiskā piemērošana. Iepriekš minētie jautājumi ir atspoguļoti un papildināti ar Statistikas datiem no Tieslietu ministrijas un ar tiesu praksi. Atslēgvārdi: Krminālatbildības minimālais vecums nepilnagdība nepilngadīgo sodīšana resocializācija The theme of the master paper “The aspect of criminal liability of under-aged in the criminal law of Latvia and foreign countries” and it is research objective, basing on the existing legislation in Latvia and some other particular foreign countries, is to analyze in comparative way the Criminal-law institutions, connected with regulation of criminal liability for under-aged in Latvia as well as other foreign countries. In this master paper there while studying scientifically-theoretical views of authors from different periods, as well as legislation of different countries on the offence of under-aged subject, paying special attention to the minimal age, from which the criminal liability takes place, as well studying the historical development of the issue, it is drawn to the conclusion that the legislator of Latvia has complied the Criminal-law with international regulation demands on the issue. In the chapters and sub-chapters of the paper there while viewing issues on peculiarities of punishment application for under- aged in the criminal-laws of Latvia and other countries, devoting part of the paper to the historical development of the issue, it is drawn to the conclusion that in the criminal-law of Latvia there should be made such changes as reduction of minimal limit of liberty’s deprivation for under-aged. In this master paper there while viewing such issues as history of probations, starting with the establishment of this institution in the other countries and its developments, in relation to applications of under-aged. While working on this issue, there are emphasized those opportunities, which in are possible to implement in the case of suspended sentence with the help of State’s service of probation, which territorial departments are in all regions of Latvia, where it is possible to implicate under-aged convicted in different programs the aim of which is to reduce the relapse of offence. A part of the paper is dedicated to applications of concerning coercive methods of educational character, by studying these issues in their historical development in Latvia. Above mentioned issues are reflected and supplement with data from the Ministry of Justice and judicial practice.
