Sabiedrības tiesības piekļūt informācijai saistībā ar pārstāvību Eiropas Savienības tiesā

Abstract

Maģistra darba “Sabiedrības tiesības piekļūt informācijai, kas saistīta ar pārstāvību Eiropas Savienības Tiesā” mērķis ir apzināt un detalizēti analizēt sabiedrības iespējas saņemt procesuālos dokumentus, kas attiecas uz tiesvedībām EST. Lai sasniegtu minēto mērķi, autore identificē 5 uzdevumus. Pirmais no tiem ir izpētīt tiesiskā regulējuma, kas skar sabiedrības tiesības piekļūt ES iestāžu dokumentiem, vēsturisko attīstību. Otrais uzdevums ir salīdzināt sabiedrības iespējas piekļūt procesuālajiem dokumentiem EST un citās starptautiskajās tiesās. Trešais uzdevums ir apzināt un izpētīt EST judikatūru attiecībā uz izņēmumu piemērošanu no sabiedrības tiesībām saņemt dokumentus. Ceturtais uzdevums ir veikt eksperimentu, lai noskaidrotu jauno pētnieku iespējas saņemt prejudiciālā nolēmuma lūgumu pētniecības nolūkiem. Un, visbeidzot, piektais uzdevums ir izdarīt secinājumus par iegūtajiem rezultātiem. Maģistra darba mērķu un uzdevumu izpilde ir balstīta uz EST judikatūras analīzi, salīdzinājumu, kas veikts, analizējot sabiedrības iespējas piekļūt procesuāliem dokumentiem ECT, EBTA tiesā, Starptautiskajā tiesā, Starptautiskajā jūras tiesību tribunālā, Amerikas Cilvēktiesību tiesā un Starptautiskajā Ruandas kara noziegumu tribunālā. Darbā izmantotas juridiskajā literatūrā izteiktās atziņas, kā arī analizēti Pārskatāmības regulas sagataves dokumenti un ES iestāžu ikgadējie ziņojumi par informācijas pieprasījumiem. Maģistra darbā kopumā analizēti 96 literatūras avoti, kuru atlase ir veikta izmantojot Latvijas Universitātes un Rīgas Juridiskās Augstskolas bibliotēkās pieejamos resursus, EST elektronisko datu bāzi un autores informācijas pieprasījumus. Maģistra darba rezultāti ir izklāstīti 8 kopsavilkuma tēzēs, kurās apkopoti secinājumi un priekšlikumi atklātības līmeņa paaugstināšanai.

The aim of the master thesis “Right of public to access information related to the proceedings before the Court of Justice of the European Union” is to identify and analyse, in depth, right of public to access documents related to the proceedings before the Court of Justice of the European Union. The author has identified 5 main tasks in order to achieve this aim. The first task that was set was to examine the historical development of the relevant legislation governing public rights to receive documents. The second was to compere opportunities of public to access documents originating from the Court of Justice of the European Union and other international courts and tribunals. The third was to conduct an analysis of case law the Court of Justice of the European Union related to relevant exceptions from public access. The fourth was to carry out the experiment in order to ascertain whether it is possible for researchers to receive a preliminary ruling text itself. And finally, fifth task was to generalize all findings and make conclusions. The accomplishment of the master thesis’ aim and tasks is based on analysis of the case law originating from the Court of Justice of the European Union, comparison of practises among different international courts and tribunals, including European Court of Human Rights, The Court of Justice of the European Free Trade Association, International Court of Justice, Inter-American Court of Human Rights, International Tribunal for the Law of the Sea and International Criminal Tribunal for Rwanda. In total, 96 sources of legal literature, laws and case-law are studied in the master thesis being selected by exploring available resources and electronic databases at the libraries in University of Latvia and Riga Graduate School of Law. The findings of the master thesis are set out in 8 brief conclusions and suggestions to achieve higher level of transparency.
