Parlamenta ētika; procesuālais aspekts

Abstract

Bakalaura darba tēma „Parlamenta ētika; procesuālais aspekts” ir aktuāla gan no teorētiskā, gan praktiskā viedokļa, jo Latvijā šis jautājums līdz šim nav pētīts, bet no deputātu ētikas ir atkarīga sabiedrības uzticība parlamentam un valsts varai vispār. Darba mērķis ir izpētīt Saeimas deputātu ētikas kodeksā ietverto regulējumu un tā piemērošanas praksi. Darbs ir strukturēts trijās daļās. Pirmajā daļā ir aplūkota parlamenta vieta un loma demokrātiskā valsts iekārtā, kā arī ētikas kodeksa jēdziens un ārvalstu parlamentu ētikas kodeksi. Otrajā daļā ir aplūkota Saeimas deputātu ētikas kodeksa izstrādāšanas vēsture, bet trešajā Saeimas deputātu ētikas kodeksa pārkāpuma lietas izskatīšanas procedūra. Darba gaitā tika atklāti procesuāli pārkāpumi Saeimas Mandātu, ētikas un iesniegumu komisijas darbībā, kā arī tika secināts, ka komisijai ir nepieciešams piešķirt tiesības ierosināt Saeimas deputātu ētikas kodeksa pārkāpuma lietu pašai pēc savas iniciatīvas. Theme of bachelor’s thesis „Parliamentary ethics; procedural aspect” is relevant both from theoretical and practical point of view, because in Latvia the issue of parliamentary ethics has not been studied until now, but public confidence in parliament and state power depends on deputies' ethics. Aim of bachelor’s thesis is to examine Code of ethics for members of the Saeima of the Republic of Latvia. The work is structured in three parts. The first part deals with parliament in democratic political system and with concept of a code of ethics and codes of ethics of foreign parliaments. The second part deals with history of drafting the code of ethics for members of the Saeima of the Republic of Latvia. The third part deals with procedure for examining breaches of code of ethics for members of the Saeima of the Republic of Latvia. The author has discovered procedural violations in work of Mandate, ethics and submissions committee. The author has concluded that Mandate, ethics and submissions committee should be granted the right to start the MPs code of ethics violation case on its own initiative. Scope of bachelor’s thesis is 65 pages, including 3 annexes. There are 182 sources used.
