Jaunākās tendences genocīda mens rea konstatēšanā

Abstract

Genocīda nozieguma mens rea jeb subjektīvā puse ir sarežģīts starptautisko krimināltiesību jautājums, ar kura risināšanu un interpretāciju 21. gadsimtā īpaši aktīvi nodarbojas starptautiskās tiesas un tiesībzinātnieki. Tradicionālā genocīda mens rea pieeja paredz, ka genocīda noziegumā jākonstatē specifisks personas nodoms, kas vērsts tieši pret aizsargātās grupas iznīcināšanu. Apkopojot un analizējot jaunākās atziņas genocīda tiesībās, bakalaura darbā secināts, ka genocīda tiesību pētnieki rosina paplašināt mens rea izpratni, pieļaujot genocīda noziegumā konstatēt arī citas vainas formas.

The mens rea or the subjective element of genocide is a complex matter of international criminal law that has been addressed and interpreted actively by international courts and legal scholars in the 21st century. The traditional approach to the mens rea of genocide requires a specific intent directed particularly towards destruction of the protected group to be determined in the crime of genocide. After summarising and analysing the latest opinions of legal scholars, it has been concluded in the Bachelor thesis that the researchers of genocide law suggest expanding the concept of mens rea that would allow other forms of culpability to be determined in the crime of genocide.
