Preses pienākums informēt sabiedrību - robeža starp informācijas nodošanu un naida kurināšanu

Abstract

Bakalaura darba “Preses pienākums informēt sabiedrību – robeža starp preses brīvību un naida kurināšanu” mērķis ir noteikt šo abu tiesisko jēdzienu līdzsvarošanas kritērijus. Lai to izdarītu, autore apskatīja arī tādus jautājumus, kā “preses” jēdziena un preses brīvības izpratne, kā arī naida runas saturu. Kritēriju konstatēšana tika izmantota Eiropas Cilvēktiesību tiesas prakse, kas risina šo un līdzīgus jautājumus. Papildus tam, autore izvirzīja medija regulēšanas veidus, kas piemērotāki mūsdienu informācijas tehnoloģiju laikmetam, kā arī uzsvēra naida runas aizlieguma neviennozīmīgo vērtējumu kā teorijā, tā praksē.

The aim of this bachelor’s thesis is to define criteria for balancing the freedom of the press and hate speech. To do this the author of the thesis has looked at the different interpretations of the definition of “press” and also the meaning behind the freedom of the press, as well as contents of hate speech which does not have a unified definition. To define this criteria the author used case law that have been brought to the European Court of Human rights, that analyzes this and similar questions. In addition the author has expressed possible novations to the regulation of the media as well as highlighted the mixed views on the prohibition of hate speech.
