Valsts suverenitāte Eiropas Savienībā

Abstract

Līdz ar globalizācijas straujo attīstību un dažādu starptautisko organizāciju kompetenču palielināšanos, tiesību zinātnē parādās nepieciešamība pārskatīt vēsturiski lietoto jēdzienu jēgu un būtību, piemērojot tos mūsdienu situācijai vai pārbaudot, vai šāda piemērošana vairs ir iespējama. Šī iemesla dēļ darba nosaukums ir “Valsts suverenitāte Eiropas Savienībā”. Darba mērķis galvenokārt bija izprast kādu ietekmi un vai vispār uz valsts suverenitāti atstāj Eiropas Savienība, kā šis jēdziens ir laika gaitā attīstījies un mainījies. Lai sasniegtu darba mērķi, tika analizēti gan vietēja, gan starptautiska mēroga normatīvie akti, tiesu nolēmumi, viedokļi un atzinumi, zinātniskā literatūra, populārzinātniskā literatūra, periodiskie izdevumi, kā arī pētīti interneta resursi. Darba ietvaros autore noskaidroja, ka Eiropas Savienības ietekme uz tās dalībvalstu suverenitāti ir ievērojami lielāka nekā autorei līdz tam bija šķitis, turklāt, analizējot dažādus tiesību avotus, viņa nonāca pie secinājuma, ka suverenitātes jēdziens vispār kopumā ir novecojis un daudzās valstīs, tai skaitā arī Latvijā, to nešķiet piemēroti lietot. Šī iemesla dēļ darba lielākais ieguldījums, autoresprāt, bija sniegt pamatojumu tam, kāpēc valsts suverenitāte drīzāk būtu jāaizstāj ar valsts patstāvību, kā arī tika sniegti priekšlikumi, kā Eiropas Savienību atkal padarīt tuvāku tās dalībvalstīm, lai tai netiktu pārmests demokrātijas trūkums.

With the rapid development of globalization and the increase in the competences of the different international organizations, in jurisprudence there is a need to revise the meaning and the nature of the historically used concepts, applying them to modern reality or checking is this kind of applying even possible. For this reason, the work title is “State sovereignty in the European Union”. The main aim of this research was to understand if the European Union dose leave an impact to a state sovereignty and if so how big of an impact it leaves and how it has evolved and changed over the time. In order to achieve the objectives of this research - both local and international laws, regulations, judicial decisions, opinions of the scientific literature, popular scientific literature, periodicals were analyzed, as well as the Internet resources was explored. Within the framework of the research, author learned that the impact that European Union leaves on the sovereignty of their Member States is considerably higher, than the author until then had ever seen, moreover, analyzing the various sources, she concluded that the concept of sovereignty is in out-of-date and it seems that it is not the appropriate term to use anymore. For this reason, according to the author - the largest contribution, was to provide a justification as to why the national sovereignty should be replaced with national autonomy, as well as the proposals were made to make the European Union closer to its Member States once again because of the lack of democracy it has.
