Bakalaura darbs ir veltīts institūtam, kas regulē neatņemamās daļas tiesīgo atstumšanu no mantojuma. Darba gaitā izpētīts neatņemamās daļas tiesīgo jēdziens un vēsturiskā attīstība, kā arī atstumšanas no mantojuma jēdziens un pamati. Ir svarīgi izprast šī institūta nozīmi un regulējumu, tādēļ darba gaitā tika apkopota pieejamā literatūra, tiesu prakse, kā arī ārvalstu tiesību normu regulējumi par šo institūtu. Šo institūtu mērķis ir noteikt tiesības testatora tuvākajiem radiniekiem- izprasīt sev pienākošos neatņemamo daļu. Šīs tiesības ierobežo testatora pēdējās gribas izpaudumu. Darba mērķis ir izprast, kā izveidojies pašreizējais neatņemamās daļas tiesīgo institūts un pierādīt, ka minētais regulējums ierobežo testatora pēdējās gribas izpauduma brīvību. Darba autore vēlas izvirzīt pilnveidošanas priekšlikumus Latvijas Republikas Civillikuma regulējumā. The Bachelor's Thesis is devoted to the institute that regulates the inalienable shares of the eligible’s exclusion from the inheritance. The concept and historical development of the inalienable shares as well as the exclusion from the heritage concept and basics of the eligible were researched in this thesis. It is important to understand the role of this institute and regulation, so in the course of this research the available literature, case law, as well as foreign law regulations of the Institute were summarized. The aim of this research is to understand how the current inalienable shares of the eligible Institute came to be and to prove that those rules restrict the freedom of expressing the testator's last will. The author wishes to put forward proposals for improving the Latvian Civil Law framework. The purpose of this Institute is to define the rights of the testator's closest relatives to demand the rightful inalienable shares. This right is limited by the last will of the testator.
