Bakalaura darba “Apcietinājuma Kriminālprocesualā reglamentācija Latvijā” problēmjautājumi ir izmeklēšanas tiesneša izvēle piemērot visstingrāko drošības līdzekli - apcietinājumu, kas ir bieži piemērots, salīdzinot ar plašo drošības līdzekļu klāstu, apcietinājuma piemērošanas pamata pamatotība un likumība, termiņa ilgums un aprēķināšanas grūtības. Bakalaura mērķis padziļināti izpētīt apcietinājuma jēdzienu un piemērošanas pamatu un kārtību, kā arī salīdzināt apcietinājuma regulējumu ar kriminālprocesu ārvalstīs – Igaunijā un Krievijas Federācijā, un izzināt ar apcietinājuma piemērošanu saistītās problēmas un piedāvāt apcietinājuma reglamentācijas uzlabojumus. Bakalaura darbs sastāv no ievada, 5 nodaļām – apcietinājuma kā procesuālā piespiedu līdzekļa jēdziena, apcietinājuma piemērošanas kārtības, apcietinājuma procesuālās kārtības, apcietinājuma termiņa un pārsūdzēšanas kārtības un kontroles pār apcietinājuma piemērošanu, un 9 apakšnodaļām, kopsavilkuma. Bakalaura darbā tiek apkopoti statistikas dati par apcietinājuma piemērošanu 2015. - 2017. gadam, salīdzinot apcietinājuma piemērošanu ar citiem procesuāli piespiedu līdzekļiem. Bakalaura darba kopsavilkumā ietvertas kriminālprocesa nepilnības un piedāvāti apcietinājuma reglamentācijas risinājumi. The problem question that is researched in the bachelor`s paper “The Regulation of Arrest in the Criminal Law of the Republic of Latvia” is the decision by examining judge to impose the severest security measure – arrest which is often imposed in comparison with the wide range of possible security measures. Another research questions are the validity and legitimacy of imposing arrest, the term of punishment and difficulties in its calculation. The aim of the bachelor`s paper is to thoroughly examine the notion of arrest and the basis for its imposing and regulation as well as to compare the regulation of arrest in foreing criminal procedure law, namely, in the Republic of Estonia and in the Russian Federation. The author of the research paper also aims to identify problems connected with the imposing of arrest and to propose possible enhancements in the regulation of arrest. The bachelor`s paper consists of the introduction, 5 chapters, 9 sub-chapters and the conclusions. The chapters are – the notion of arrest as a procedural measure of constraint, the procedure of imposing arrest, the procedural order of arrest, the procedure of imposing arrest term and the procedure of appeal, and the control over the imposing of arrest. The statistic data about imposing arrest in the period from 2015 until 2017 has been collected and summarized in the bachelor`s paper by comparing imposing of arrest with other procedural measures of constraint. In the conclusion the bachelor`s paper the deficiencies of the Criminal Law are stated and possible solutions of regulation of arrest are offered.
