Bakalaura darba nosaukums ir “Kriminālatbildības noilgums’’. Bakalaura darbā tiek pētīts šobrīd spēkā esošais normatīvais regulējums attiecībā uz kriminālatbildības noilgumu, kā arī salīdzināts ar vēsturisko regulējumu. Tēmas aktualitāti nodrošina apstākļi, ka spēkā esošais normatīvais regulējums Latvijā ir nepilnīgs un praksē rada situācijas, kas nereti ir par labu nozieguma izdarītājam. Nav pieļaujams tas, ka nozieguma izdarītājs paliek nesodīts kriminālatbildības noilguma dēļ, tomēr cietušajām personām nākas vienkārši samierināties ar radušos situāciju. Nedrīkst pieļaut to, ka noziedzīga nodarījuma veicējs spēj izvairīties no soda saņemšanas tikai tāpēc, ka iestājies noilgums. Bakalaura darba mērķis ir analizēt noilguma jēdzienu krimināltiesībās, pētīt un salīdzināt kriminālatbildības noilguma likumiskos pamatus, salīdzināt tiesību normu reglamentāciju Latvijā un ārvalstīs, kā arī praksē pastāvošo, reālo situāciju kriminālatbildības noilguma piemērošanā. Veiktā pētījuma rezultātā autors sniegs priekšlikumus un secinājumus, atspoguļojot praksē pastāvošos problēmjautājumus. Lai veiksmīgi sasniegtu darba mērķi, darba autors izvirza šādus uzdevumus: 1. pētīt, analizēt un salīdzināt pieejamo ārzemju un latviešu literatūru, normas, kā arī pieejamo tiesu praksi šī jautājuma reglamentācijā. 2. atspoguļot problēmjautājumus kriminālatbildības noilgumu piemērošanā; 3. sniegt priekšlikumus Latvijas Republikas Krimināllikuma 56. panta uzlabošanai. Bakalaura darba autors skata atbrīvošanas no kriminālatbildības tiesisko regulējumu, konkrētāk izpētot vienu atbrīvošanas veidiem, noilgumu, atklāj aktuālās problēmas spēkā esošajā regulējumā attiecībā uz kriminālatbildības noilgumu. Autors bakalaura darba ietvaros sniedz konkrētus priekšlikumus efektīvākai noilguma termiņu piemērošanai, kā arī to apturēšanai, lai izpildītu kriminālsoda noteikto mērķi – iedarbotos preventīvi un neļautu personai izvairīties no kriminālatbildības arī pēc gadiem. The title of the Bachelor’s Paper is “Limitation Period for Criminal Liability’’. The Bachelor’s Paper studies legislation currently in force regarding the limitation period for criminal liability, and compares it to the historic legislation. The topicality of the theme is based on the fact that the legislation currently in force in Latvia is incomplete and in practice it often works in favour of the offender. It is unacceptable that the offender gets away with punishment due to the limitation period for criminal liability, however the victims have to endure such situation. It is not acceptable that the offender is able to avoid the punishment only because the limitation period has set in. The aim of the Bachelor’s Paper is to analyse the concept of the limitation period in criminal law and to study and compare the legal grounds of the limitation period for criminal liability, to compare the regulations of legal norms in Latvia and abroad, and the real situation regarding practical application of the limitation period for criminal liability. As a result of the study the author is going to provide suggestions and conclusions, reflecting the issues currently encountered in practice. In order to achieve the aim of the Paper successfully, the author has identified the following tasks: 1. To study, analyse and compare available foreign and Latvian literature, legal norms and available case-law regarding the regulation of this issue. 2. To reflect the issues in the application of the limitation period for criminal liability; 3. To provide suggestions to improve Section 56 of the Criminal Law of the Republic of Latvia. The author of the Bachelor’s Paper studies the legislation regarding release from criminal liability, and in particular studying one way of the release from criminal liability, the limitation period, the author identifies the actual issues of the effective legislation with regard to the limitation period of criminal liability. In the Bachelor’s Paper, the author provides specific suggestions for efficient application of the limitation period, as well as for their termination to achieve the purpose of criminal punishment – to take preventive action and not to allow a person to avoid criminal liability even if a long period of time has passed.
