Viens no veidiem, kā nodrošināt tiesības uz labvēlīgu vidi, kuras ir nostiprinātas Latvijas Republikas Satversmes 115.pantā, ir izveidot īpaši aizsargājamas dabas teritorijas. Arī īpašuma tiesību aizsardzība ir nostiprināta Latvijas Republikas Satversmes 105.pantā. Šajā darbā ir analizēts šo abu konstitucionālo tiesību saturs un ietvars, un kā tās atspoguļojās īpaši aizsargājamu dabas teritoriju aizsargāšanā. Darba mērķis ir izpētīt, kā panākt tiesību uz īpašumu un tiesību dzīvot labvēlīgā vidē līdzsvaru un analizēt to regulējumu, lai noskaidrotu iespējamās problēmas un risinājumus. Šajā darbā īpaša uzmanība ir vērsta īpašuma tiesību ierobežošanas samērīgumam īpaši aizsargājamās dabas teritorijās, kas ir izveidotas, lai īstenotu dabas aizsardzību. Darba rezultātā tiek piedāvāts izstrādāt Ministru kabineta individuālos aizsardzības un izmantošanas noteikumus Latvijas dabas rezervātiem. Šie noteikumi ir nepieciešami, lai tiktu ievērots samērīguma princips īpašuma tiesību ierobežošanā, kā arī tiek vērsta uzmanība citiem šo tiesību līdzsvarošanas kritērijiem. One of the ways to ensure the rights to a benevolent environment which are consolidated in Article 115 of the Constitution of the Republic of Latvia is to establish specially protected nature territories. Also protection of the property rights is consolidated in Article 105 of the Constitution of the Republic of Latvia. In this work content of both of these constitutional rights are analyzed and the framework how it is reflected in the protection of the specially protected nature territories. The aim of the work is to study how to ensure the balance of property rights and rights to live in a benevolent environment and to analyze its regulation to clarify possible problems and solutions. In this work special attention is paid to the proportionality in the restriction of the property rights in the specially protected nature territories established to implement the environment protection. In the conclusions of this work it is offered to develop the regulation of the Cabinet of Ministers for the individual protection and usage for the strict nature reserves in Latvia. This regulation is necessary to ensure the compliance with the principle of the proportionality in the restriction of the property rights, as well as attention is paid to the other these rights balancing criteria.
