Valsts prezidenta zvēresta būtība un tā satura dažādības pasaules valstu konstitūcijās

Abstract

Vairākums pasaules valstu konstitūcijas ietver Valsts prezidenta zvēresta jeb svinīgā solījuma institūtu. Zvēresta devējs dod solījumu rīkoties tautas interesēs un aizsargāt valsts konstitūciju. Tomēr nav vienotā viedokļa par to, vai zvērestam ir juridiskā nozīme, vai tā došana ir simbolisks akts. Pētījuma mērķis ir konstatēt zvēresta institūta būtību, jēgu un satura īpatnības, ka arī izvērtēt svinīgā solījuma institūtu Latvijas Republikas Satversmē. Tā kā Valsts prezidentu zvēresti pasaules valstu konstitūcijās atšķiras pēc formas un satura, ir svarīgi izpētīt zvēresta nozīmi un tā vēsturisko attīstību, kā arī izanalizēt Valsts prezidentu zvērestu īpatnības ārvalstu konstitūcijās.

Many of the world constitutions include the institute of the President’s oath or solemn affirmation. Oath taker makes the promise to act in the interests of the nation and to defend the constitution. However, there is no common opinion if the oath has legal meaning, or it is the symbolic act. The aim of the research is to establish the idea and the meaning of the oath institute and to evaluate the institute of the solemn affirmation in the Constitution of the Republic of Latvia. Since the Presidents’ oaths in the world constitutions differ on the form and content, it is relevant to study the nature of the oath and its historical development and to analyze the particularities of oaths in constitutions of foreign countries.
