State-owned enterprises play an increasingly significant role in the global economy, including foreign direct investment. The purpose of the research is to clarify in what cases may the state-owned enterprise claim its investment protection, specifically – take an untraditional status as the claimant in international investment disputes opposing another state. In pursuit of the purpose, the notion of an investor within international investment treaties is analysed, as well as the separation of the state enterprise and the state in the precedents of investment arbitration. The main challenges of allowing the status of the claimant for state-owned enterprises are identified, as well as their solutions are proposed in the research.
