Ukrainas atbildības robežas par starptautisko tiesību pārkāpumiem Doņeckas un Luhanskas tautas pašpasludinātajās republikās

Abstract

Darbā vispārīgi tiek apskatīts valsts atbildības jēdziens un valsts atzīšanas priekšnoteikumi. Darba teorētiskā daļa tiek attiecināta uz Ukrainas konfliktu, nosakot Doņeckas un Luhanskas Tautas Republikas statusu, kā arī, izvērtējot Ukrainas atbildību par notiekošo Ukrainas austrumos – gan valdības, gan nemiernieku kontrolētajās teritorijās. Pētījuma mērķis ir aplūkot minētos starptautisko tiesību institūtus un vēlāk tos piemērot faktiskajai situācijai Ukrainas austrumos. Darbā autors aplūko starptautisko tiesu un starptautisko kara tribunālu tiesu praksi, starptautiski atzītu autoru monogrāfijas saistībā ar aplūkojamo mērķi, kā arī pēta starptautiskās konvencijas. Darba noslēgumā autors pievērš uzmanību Ukrainas atbildībai par notiekošo Doņeckas un Luhanskas apgabalā.

The paper generally examines the institutes of State responsibility and State recognition. The theoretical part of the paper is applied to the conflict in the Ukraine, declaring status of Donetsk and Luhansk People’s Republic, as well as evaluating Ukraine’s responsibility for actions of the East of Ukraine – both the government and the rebel controlled territories. The main task of the paper is to view the mentioned institutions of international law and apply them to the actual situation in the East of the Ukraine. The author considers cases of international courts and war tribunals, monographies relating to the topic of internationally recognized authors, as well as international conventions. In conclusion, the author draws attention to the responsibility of the Ukraine in Donetsk and Luhansk area.
