Noteikta vecuma sasniegšana kā pamats valsts civildienesta attiecību izbeigšanai

Abstract

Bakalaura darbā “Noteikta vecuma sasniegšana kā pamats valsts civildienesta attiecību izbeigšanai”, vispusīgi izpētīts dienesta attiecību izbeigšanās pamats – valstī noteiktā pensijas vecuma sasniegšana. Darba mērķis ir šī dienesta attiecību izbeigšanās pamata padziļināta analīze, lai atklātu ar to saistītos problēmjautājumus. Darba ietvaros ir analizēta normatīvā regulējuma vēsturiskā attīstība; starptautiskais regulējums un Eiropas Savienības dalībvalstu regulējums šajā jautājumā; institūta nepieciešamība un plānotie grozījumi. Tā kā atsevišķus jautājumus neregulē likums, tad to izpratnei izmantota iestāžu sniegto atbilžu un tiesu prakses analīze. Darbā analizēts arī atlaišanas pabalsta institūts, kurš praksē radījis neskaidrības attiecībā uz tā piešķiršanu personām, ar kurām dienesta attiecības turpinātas pēc pensijas vecuma sasniegšanas.

Bachelor thesis “Reaching of a certain age as means for termination of civil service” shows thorough research for one of the grounds for termination of civil service – reaching the state retirement age. The aim of this study is to analyze termination of civil service based on reaching the states set retirement age and to discover related issues. This study shows analysis of historical development of laws regarding this ground for termination of civil service; international and European Union member state regulations; necessity of this law and possible changes. Analysis of state institution replies and jurisprudence are used in order to understand certain aspects that are not covered by law. The study also covers the topic of severance pay, because in practice there has been confusion regarding those civil servants with whom civil service relationship has been extended.
