Advokāta profesionālais noslēpums un tā ierobežojumi

Abstract

Bakalaura darbs Advokāta profesionālais noslēpums un tā ierobežojumi izstrādāts ar mērķi izpētīt, ko sevī iekļauj advokāta pienākums ievērot konfidencialitāti un neizpaust profesionālo noslēpumu un apkopot tos gadījumus, kad šī pienākuma ievērošana tiek ierobežota. Pētījumā apskatīti zvērinātu advokātu ētikas pamatprincipi, plašāku uzmanību pievēršot konfidencialitātes principam. Aplūkots arī, ko sevī ietver advokātam uzliktais pienākums neizpaust profesionālo noslēpumu, darba izstrādes gaitā noskaidrojot, kas ir tie gadījumi, kad iespējama atkāpe no šī pienākuma pildīšanas. Lai uzlabotu konfidencialitātes principa ievērošanu advokātu vidū, autore ierosina aktualizēt šo jautājumu, pievērst plašāku uzmanību to gadījumu apskatīšanai, kad šī principa ievērošana tiek ierobežota.

The aim of a bachelor's paper The lawyer's professional secrecy and it's restrictions is to explore what the lawyer's obligations of confidentiality and professional secrecy does include, as well as to collect those cases where the obligation of duty is restricted. This study examines the basic principles of a lawyer's ethics with the main focus on the obligations of confidentiality. The imposed on the lawyer obligations of professional secrecy also, has been taken look at. And while work in progress - ascertaining which are those cases where derogation from the obligation of duty was possible. In order to improve the observance of confidentiality among lawyers, the author proposes to raise this question, while paying more attention to the cases where this principle is restricted.
