Pārrobežu ceļu satiksmes negadījumiem piemērojamais likums

Abstract

Bakalaura darba tēma ir „Pārrobežu ceļu satiksmes negadījumos piemērojamais likums”. Bakalaura darba mērķis ir noskaidrot, kādos gadījumos tiek piemērota 1971. gada 4. maija konvencija „Konvencija par ceļu satiksmes negadījumiem piemērojamo likumu” un Eiropas Parlamenta un Padomes Regula Nr. 864/2007, un kā šie divi starptautiskie normatīvie akti mijiedarbojas un atšķiras. Kā arī, izpētīt, vai tos savā praksē pielieto apdrošinātāji. Pētāmās problēmas galvenais iemesls - apdrošinātāji, nosakot atbildību un aprēķinot apdrošināšanas atlīdzību par zaudējumiem, kas cietušajām personām radušies ceļu satiksmes negadījuma rezultātā, piemēro tās valsts likumu, kurā tas noticis, nevis meklē piemērojamās tiesību normas starptautiskajos normatīvajos aktos, respektīvi, 1971. gada 4. maija konvencijā „Konvencija par ceļu satiksmes negadījumiem piemērojamo likumu” un Eiropas Parlamenta un Padomes Regulā Nr. 864/2007. Bakalaura darbam ir trīs nodaļas, kuras tiek iedalītas atsevišķās apakšnodaļās. Pirmajā nodaļā autore atklāj izvirzītās tēmas aktualitāti, kas kalpo par pamatu turpmāko nodaļu satura izpētei. Otrajā nodaļā autore aplūko pārrobežu ceļu satiksmes negadījumos piemērojamā likuma normatīvo regulējumu, to mijiedarbību un izpēti tiesu praksē. Trešajā nodaļā ir veikta aptaujas anketās iegūto datu analīze un interpretācija. Bakalaura darba nobeigumā tiek sniegti secinājumi un priekšlikumi par darbā izpētītiem datiem un iegūtajiem rezultātiem. Darbā tika izmantoti 45 literatūras avoti, tai skaitā juridiskā literatūra, normatīvie akti un juridiskās prakses materiāli. Darba kopējais apjoms ir 48 lapas (bez pielikumiem). Topic of the bachelor’s thesis is „The Law Applicable to Cross-Border Road Traffic Accidents”. The aim of the bachelor’s thesis is to find out in what cases convention from May 4, 1971 “Convention on Law Applicable to Traffic Accidents” and European Parliament and Council Regulation No. 864/2007 are applied and how these two international regulatory acts interact and differ from each other. As well as to research whether they are used in practice by insurers. The main reason of the problem behind research – insurers upon establishing liability and calculating insurance indemnity for losses that have occurred to the victims as a result of road traffic accident, apply the law of the country, where the accident occurred, instead of searching for applicable provisions of law in international regulatory acts, namely, convention from May 4, 1971 „Convention on Law Applicable to Traffic Accidents” and European Parliament and Council Regulation No. 864/2007. Bachelor’s thesis is divided in three chapters which are divided further in separate sections. In the first chapter the author reveals topicality of the raised topic which will serve as a basis for the research of the following chapter contents. In the second chapter the author elaborates on normative regulation of the law applicable to cross-border traffic accidents, its interaction with and research within legal practice. In the third chapter survey is performed and analysis and interpretation of the results obtained. At the end of the bachelor’s thesis conclusions are drawn and recommendations provided regarding the researched data and obtained results. 45 literature sources, including legal literature regulatory acts and legal practice materials are used in the thesis. The thesis contains 48 pages in total (without annexes).
