Izmeklēšanas eksperiments, operatīvais eksperiments un speciālais izmeklēšanas eksperiments: salīdzinoša analīze

Abstract

Darba tēma: Izmeklēšanas eksperiments, speciālais izmeklēšanas eksperiments un operatīvais eksperiments – salīdzinoša analīze. Darbā analizēts: juridiskajā praksē izmantoto eksperimentu kopīgais un atšķirīgais. Darba mērķis: izpētīt minēto eksperimentu vispārīgos raksturojumus, veikšanas faktisko un juridisko pamatu, veikšanas kārtības īpatnības, iegūto rezultātu noformēšanu un izmantošanu kriminālprocesā, iepazīties ar eksperimentu noregulējumu ārvalstīs, tādējādi izanalizējot katru no eksperimentiem un salīdzinot tos vienu ar otru, lai saprastu kopīgās un atšķirīgās iezīmes eksperimentu starpā. Darba uzdevumi: izpētīt attiecīgo literatūru Latvijā, ārvalstīs, analizēt katru no eksperimentiem, salīdzināt tos, apkopot iegūto informāciju, izdarīt secinājumus. Iegūtie rezultāti: iegūts pārskats par eksperimentu kopīgo un atšķirīgo. Salīdzinot ar ārvalstu normatīvo regulējumu, daudzu valstu kriminālprocesa kodeksos nemaz nav ietverts speciālais izmeklēšanas eksperiments, kurš Latvijā ir vērtējams kā veiksmīgs pierādījumu iegūšanas veids, kurš līdzās citiem juridiskajā praksē izmantotajiem paņēmieniem palīdz samazināt noziedzību. The theme of the bachelor paper: Comparative analysis of experimental investigation, special experimental investigation and operational experiment. The analysis of: Similarities and differences of in legal practise used experiments. The aim of the bachelor paper: To explore the characteristics of the experiment and the factual and legal foundation of carrying it out. To explore how the experiment is carried out, how the results are gathered and used in Criminal Proceedings. To obtain information on how experiments are adjusted abroad so it is possible to analyse every experiment and to make a comparison in order to understand the similarities and diferences between experiments. The objectives of the bachelor paper: To explore needed literature in Latvia and abroad, to analyse every experiment, to compare and summarise them, to draw conclusions. The results of the bachelor paper: The summary of similarities and difercences of experiments were obtained. Comparing it to abroad where in the Code of Criminal Procedure special experimental investigation is not included, in Latvia it is successful way how to get evidence and to reduce crime.
