Mantojuma tiesības regulē procesus, kas notiek pēc cilvēka nāves. Cilvēkam nomirstot, visa viņa manta pārvēršas mantojumā, un mantojumam jākļūst par mantinieka īpašumu. Lai mantinieks iegūtu mantojumu savā īpašumā, nepieciešams veikt darbību, pozitīvu gribas izpaudumu – mantojuma pieņemšanu. Mantojuma pieņemšana ir viens no būtiskākajiem posmiem mantojuma procesā. Vēlāk mantojumu atraidīt vairs nav iespējams. Šajā darbā autore apskatīs mantojuma pieņemšanas institūtu, tā vēsturisko attīstību. Tiks meklēti un analizēti problēmjautājumi, būtiskākās iezīmes mantojuma pieņemšanas veidos, noteiktajos mantojuma pieņemšanas termiņos un sekās, kas rodas mantojumu pieņemot. Pētījuma rezultātā autore secina, ka mantojuma pieņemšanas institūtā ir nepieciešami uzlabojumi, piemēram, pretrunu novēršana starp Latvijas Republikas Civillikumu un Notariāta likumu. Inheritance law regulates processes after a person’s death. When a person dies all their property becomes inheritance and this inheritance now is a property of an heir. In order of an heir to acquire inheritance as their property, there is a necessity of positive expression of intent – acceptance of inheritance. Inheritance acceptance is one of the most significant parts in the process of inheritance. Afterwards inheritance cannot be refused. The present paper examines the institution of inheritance acceptance and its historical development. The author researches and analyses topical problem issues, typical characteristics of acceptance of inheritance and its defined terms, as well as consequences of inheritance refusal. In the result of the research the author draws a conclusion that there is a need for improvements in the institution of inheritance acceptance, for instance, to eliminate inconsistency of the Civil Law and the Notariate Law of the Republic of Latvia.
