Mantojuma masas reālā sadale

Abstract

Bakalaura darba temats ir “Mantojuma masas reālā sadale”. Tas ir nozīmīgs mantojuma tiesību aspekts, ar ko jāsaskaras katram mantiniekam, ja mantojums ir piekritis vienlaicīgi vairākām personām. Darba mērķis ir izpētīt līdzmantinieku savstarpējās attiecības, tiesības prasīt mantojuma dalīšanu, mantojuma kopvaldījuma izbeigšanu, dalāmās mantas noteikšanu, iepriekšēji saņemtā pievienojumu un mantojuma masas reālo sadali. Mērķi tiks sasniegti, analizējot normatīvos aktus, salīdzinot juridiskajā literatūrā paustās atziņas un pētot mantojuma tiesību institūta vēsturisko attīstību, kā rezultātā tiks identificēti problēmjautājumi, kas šobrīd skar līdzmantinieku savstarpējās attiecības un mantojuma kopvaldījuma izbeigšanu.

Bachelor’s thesis is “Actual Division of the Inheritance”. It is an important part of Inheritance Law, which affects every heir, if the inheritance has devolved to several persons jointly. The aim is to research mutual relationships between co-heirs, the right to require division of an estate, termination of joint possession of an estate, determination of the property to be divided, additions to that which was received previously and actual division of the inheritance. Goals will be achieved by analyzing laws and regulations, comparing different ideas presented in legal doctrine and by exploring the historical development of Inheritance Law, thereby coming to conclusions about issues that currently affect mutual relationships between co-heirs and termination of joint possession of an estate.
