Advokāta pilnvarojums pārtāvībai un juridiskās palīdzības sniegšanai civilprocesā.

Abstract

Laikā, kad Latvijā notiek aktīva diskusija par advokāta procesa ieviešanu un tā apjomu, joprojām pastāv neskaidrības saistībā ar advokāta pilnvarojuma apjomu dažādu procesuālo darbību veikšanai un paša „advokāta” jēdziena nozīmi civilprocesā. Ne tikai studenti un jomas speciālisti, bet arī tiesas ne vienmēr spēj skaidri norobežot pārstāvības un juridiskās palīdzības institūtus. Autors veicis šo pētījumu, lai ne tikai veicinātu vienotu izpratni par minētajiem tiesību jautājumiem, bet arī veicinātu ātrāku un kvalitatīvāku advokāta procesa ieviešanu Latvijā, tādējādi samazinot tiesu noslogotību un padarot tiesas procesu efektīvāku. At a time, when there is an active discussion about the possibilities of implementing of the advocate's procedure in Latvia and the extent of this possibility, there still are some ambiguities in conjunction with the authorization of an advocate for carrying out several different civil-procedural actions. The term "advocate" itself and its meaning within the context of civil procedure law is unclear and unsatisfying, therefore the author has made this research not only to promote and encourage the uniform understanding and use of the aforementioned questions of law, but also to assist in a faster and higher-quality implementation of advocate's process in Latvia, thus, reducing the loaded and over-laden courts and making the court processes more effective.
