Lustrācijas izmantošanas problemātika Centrālās un Austrumeiropas valstīs

Totalitārais režīms atstāja paliekošu nospiedumu tautu atmiņās, kuras saskārās ar to 20.gadsimta pirmajā pusē, un, lai kā mēs to nevēlētos, bet Centrāleiropas un Austrumeiropas valstis līdz pat šai dienai dzīvo komunistiskās pagātnes ēnā. Tās valstis tomēr cenšas cīnīties ar totalitārisma sekām, pielietojot, tajā skaitā vienu no daudzajiem pārejas tiesiskuma perioda mehānismiem – lustrāciju. Darba mērķis ir noteikt un analizēt visnopietnākās tiesiskās problēmas, ar kurām sastopas CAE valstis lustrācijas procesā. Darba gaitā tika pētīta lustrācijas mehānisma nozīme jaunajās demokrātiskajās valstīs, tās pielietošanas nepieciešamība, kritika un nacionālo konstitucionālo tiesu, kā arī ECT spriedumi. The totalitarian regime left a strong imprint on the memory of the nations who had confronted it in the first half of the 20th century, and as much as we don't want it to be, the countries of Central and Eastern Europe currently still live in the shadows of their communist past. But some people are trying to fight the legacy of totalitarianism, among other things using one of many transitional justice mechanisms – lustration. The purpose of the Paper is to identify and analyse the acutest legal problems encountered by CEE countries in the process of lustration. The Paper examines the importance of the lustration mechanism for new democracies, the need for its application, the criticism and the decisions of the national constitutional courts, as well as the ECHR.
