Latvijas valsts dibināšanas juridiskais raksturojums

Abstract

Bakalaura darba mērķis ir analizēt ar Latvijas valsts izsludināšanu saistītos tiesību aspektus un politisko situāciju Baltijas jūras reģionā. Aplūkojamais laika periods ir no 1917. gada līdz 1920. gadam. Mērķa sasniegšanai tiek izvirzīti vairāki uzdevumi: izprast Krievijas impērijas sabrukuma iemeslus un jaunu valstu veidošanās priekšnosacījumus, skaidrot Latvijas valsts izsludināšanas juridiskās īpatnības, kā arī apzināt lielvalstu attieksmi attiecībā uz jauno valstu rašanos Baltijas reģionā un to atdalīšanos no Krievijas impērijas. Darba rezultātā tiek secināts, ka Latvijas Republikas izsludināšana kļuva iespējama pateicoties divu impēriju – Vācijas impērijas un Krievijas impērijas – sabrukumam. Latvijas valsts proklamēšanas brīdī neatbilda klasiskajām valsts pazīmēm. Tā vairāk atgādināja Vīnes skolas prof. Georga Jellineka teorijā atrodamo apzīmējumu – valsts fragments. Tomēr, kā pierāda Latvijas vēsture, „fragments” ir pierādījis savu dzīvotspēju. Darba izstrādes rezultātā tiek apstiprināta tēze, ka nav pamata apšaubīt valsts izsludināšanas tiesiskumu un pamatotību tikai tāpēc, ka valsts proklamēšanas brīdī valstij iztrūkst kāda no klasiskajām valsts pazīmēm. Būtiska ir valsts „dzīvotspēja”, kas pamatojas tautas nepārprotami skaidri izteiktā gribā pēc sava valstiskuma, latviešu tautas gadījumā – Latvijas Republikas. The aim of the paper is to analyse the legal aspects of proclamation of the Republic of Latvia and the related political situation in the Baltic Sea region from 1917 to 1920. In order to reach the aim, several enabling objectives have been set: to understand reasons of the collapse of the Russian empire and preconditions for the formation of new countries, as well as to clarify the legal peculiarities of the proclamation of the state of Latvia and to examine the attitude from superpower regarding the emergence of new states in the Baltic region and their separation from the Russian empire. The conclusion that the proclamation of the Republic of Latvia was possible because of the collapse of two empires – the German empire and the Russian empire – has been drawn. Furthermore, despite the fact that at the time of the proclamation the state of Latvia did not comply with the common characteristics of a state and therefore it reminded more of a designation found in Vienna School's prof. George Jellinek's theory – a national fragment, the history of Latvia shows that the "fragment" has proven its survivability. Thus, there is no reason to doubt the legitimacy and validity of the proclamation of a state simply because at the time of the act, the state lacks some of the common characteristics of a state. The fundamental characteristic of a state is its "viability" that is based on an explicit will of the people for their statehood, in the case of the Latvian nation - the Republic of Latvia. There is no reason to doubt the right of the Latvian nation to commemorate the 100th anniversary of the state of Latvia in 2018.
