Maģistra darba nosaukums ir "Sacīkstes princips civilprocesā". Sacīkstes princips ir viens no civilprocesa pamatprincipiem, proti, puses savas procesuālās tiesības īsteno sacīkstes formā, un tiesa lietu izspriež, vadoties no pušu iesniegtajiem pierādījumiem un izteiktajiem argumentiem. Sacīkstes princips ir pieskaitāms pie civilprocesa kopējiem jeb vispārējiem principiem, kura uzdevums ir nodrošināt likumības un līdztiesības ievērošanu nolēmumu pieņemšanas procesā, vienlaikus garantējot tiesneša neitralitāti un objektivitāti. Maģistra darba mērķis ir noskaidrot sacīkstes principa būtību un nepieciešamību civilprocesuālajās attiecībās, kā arī izpētīt Civilprocesa likuma 93. panta ceturtās daļas piemērošanu un ietekmi uz sacīksti. Tā rezultātā atklāt pozitīvos un negatīvos aspektus, izstrādāt risinājumus civilprocesuālo tiesību normu uzlabošanai, lai sekmētu efektīvu un taisnīgu civilprocesu. Izvirzītā mērķa sasniegšanai darbā risināmie uzdevumi ir šādi: 1) pamatojoties uz normatīvo aktu noteikumiem un juridiskajā literatūrā paustajām atziņām pētīt sacīkstes principa nozīmi civilprocesā; 2) atsegt pozitīvos un negatīvos sacīkstes principa aspektus spēkā esošajā procesuālajā normatīvajā regulējumā; 3) vērtēt tiesas lomu sacīkstes principa nodrošināšanā civilprocesā; 4) izdarīt secinājumus un izstrādāt priekšlikumus sacīkstes principa un to ietekmējošo procesuālo tiesību normu pilnveidošanai. The title of the Master’s Thesis is “The Adversarial Principle of Civil Procedure”. The adversarial principle of civil procedure is one of the basic principles underlying the civil procedure, namely, parties exercise their procedural rights via the adversarial system and the court passes judgement on a case in correspondence with the arguments and evidence submitted by the parties. The adversarial principle belongs to the common or general principles, and it ensures lawfulness and equality in the decision making process while guaranteeing the neutrality and objectivity of the judge. The main goal of the present Master’s paper is the clarification of the essence and necessity of the adversarial principle in civil procedural relations, as well as the research of application and impact of the fourth paragraph of Article 93 of the Civil Procedure Law on the adversarial principle. In conclusion this study aims to reveal positive and negative aspects of the adversarial principle and develop solutions improving the civil procedural provisions., thus ensuring effective and fair civil procedure, Tasks set to achieve the goals of this paper are as follow: 1) to investigate the role of the adversarial principle in the civil procedure according to the regulatory provisions and conclusions of the legal literature; 2) to identify positive and negative aspects of the adversarial principle in the current existing procedural regulatory framework; 3) to evaluate the role of the court in the provision of the adversarial principle in civil proceedings; 4) to draw up conclusions and develop suggestions that improve the adversial principle and procedural legal norms affecting it.
